HomeMy WebLinkAbout7-7-22 BA Minutes $$$ " * M I N U T E S * BOARD OF ADJUSTMENT July 7, 2022 City Hall, 801 Main Street A meeting of the Board of Adjustment was held on July 7, 2022 and called to order at 3:00 p.m. with the following members present: Chairman Dana Timaeus Board Member Jeff Beaver Board Member Joey Hilliard Board Member Tom Rowe Board Member Rogers Sorrell Jr. Alternate Board Member Christopher Jones Board Members absent: Alternate Board Member Christy Amuny Also present: Demi Engman, Senior Planner Sharae Reed, City Attorney Catherine Allen, Recording Secretary APPROVAL OF MINUTES Board Member Hilliard moved to approve the minutes for April 7, 2022. Board Member Sorrell seconded the motion. The motion to approve the minutes carried 5:0. SWEARING IN OF WITNESSES All witnesses were sworn in at 3:01 p.m. PUBLIC HEARING 1) File PZ2022-196: To consider a request for a Variance to the required side yard setback to be reduced from 5' to 2'. Applicant: Lemoine Disaster Recovery for LeAnna Taylor Location: 3370 Edmonds Avenue $ Mrs. Engman presented the staff report.Lemoine Disaster Recovery, on behalf of LeAnna Taylor, homeowner, is requesting a Variance to the property located at 3370 Edmonds Avenue. The property is zoned RM-H (Residential Multiple Family - ?USTQ_`!:QZ_U`e'!PU_`^UO`!MZP!`TQ^QR\[^Q!^Q\]aU^Q_!M!0i! building setback from the side property line. The Variance will accommodate the sidewalk to be flush to the required ADA ramp. The applicant could not apply for a reasonable accommodation as the property owner is not disabled nor resides with disabled person(s). BOARD OF ADJUSTMENT July 7, 2022 $ Lemoine Disaster Recovery is a company which has participated in the General Land Office (GLO) Disaster Recovery Program to facilitate building structurally sound homes and mitigate future flooding TMfM^P_!R\[^!OU`UfQZ_i!T\[YQ_!`TM`!TMbQ!NQQZ!MRRQO`QP!Ne!ZM`a^MX!PU_M_`Q^_*! The applicant shall have the burden of proof to demonstrate that all three conditions necessary for approval have been met: A) That the granting of the variance will not be contrary to the public interest; B) That literal enforcement of the ordinance will result in unnecessary hardship because of exceptional narrowness, shallowness, shape topography or other extraordinary or exceptional physical situation or hardship physical condition unique to the specific piece of \\^\[\\Q^`e!UZ!\]aQ_`U\[Z*!!gIZZQOQ__M^e!TM^P_TU\\h!_TMXX!YQMZ!\\Te_UOMX!TM^P_TU\\!^QXM`UZS!`\[!`TQ! property itself as distinguished from a hardship relating to convenience, financial O\[Z_UPQ^M`U\[Z_!\[^!OM\\^UOQ(!MZP!`TQ!TM^P_TU\\!Ya_`!Z\[`!^Q_aX`!R^\[Y!`TQ!M\\\\XUOMZ`!\[^!\[cZQ^i_! actions; and C) That by granting the variance, the spirit of the ordinance will be observed and substantial justice will be done. " Slides of the subject property and site plan were shown. Twenty (20) notices were mailed to property owners within two hundred (200) feet of the subject property. One response was received in favor and zero were received in opposition. Brief discussion followed concerning similar projects in the neighborhood. The public hearing was opened on this item. Florence Mayhall-Andrews, 2798 Houston Street, addressed the Board. She stated that she owns 3345 Glenwood Street and that she received a property owner notice concerning the case. She added that she came to find out what the request was about. After an explanation from Chairman Timaeus about the request, Ms. Mayhall-Andrews stated that she had no objections. Alexandra Pallis, representing Lemoine Disaster Recovery, 12563 Gulf Freeway, Houston, TX, addressed the Board. She stated that the homeowner is excited to complete the demolition and rebuilding of the home through the GLO program and that the variance is required to complete the project in order to meet the requirements for an ADA ramp. Discussion followed concerning the specifics of the variance and its future implications. Board Member Beaver moved to approve the request for a variance to the required side yard setback to be reduced from 5' to 2', as requested in File PZ2022-196. Board Member Hilliard seconded the motion. A roll call vote was taken. Chairman Timaeus-Aye, Board Member Beaver-Aye, Board Member Hilliard-Aye, Board Member Rowe-Aye, Board Member Sorrell-Aye.
