Turner Jr., At -Large ROBIN MOUTON, MAYOR Randy Feldschau, At -Large Taylor Neild, Ward I CITY COUNCIL MEETING Michael Getz, Ward II Audwin Samuel, Ward III August 30, 2022 Chris Durio, Mayor Pro Tern Tina Broussard, City Clerk Chris Boone, Interim City Manager Sharae Reed, City Attorney The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on August 30, 2022, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: ,�7-0:11i1111 Invocation Pledge of Allegiance Roll Call Proclamations, Presentation and Recognition -- Presentation by Linebarger Goggan Blair and Sampson, LLP Public Comment: Persons may speak on the Consent Agenda and Agenda item 1 Mayor Mouton called the council meeting to order at 1:30 p.m. Pastor Joseph Ibiwoye, MSP with Our Mother of Mercy Catholic Church gave the invocation. Mayor Mouton led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Mouton, Mayor Pro Tern Durio, Councilmembers Getz, Turner, Feldschau, Samuel and Neild. Also, present were Chris Boone, Interim City Manager; Sharae Reed, City Attorney; Tina Broussard, City Clerk. Proclamations, Presentation, Recognitions "Gift of Life, Prostate Cancer" — August 2022 -- Proclamation read by Mayor Mouton; accepted by Norma Sampson, Executive Director for Gift of life and others Mayor Mouton read the announcement regarding Executive Session being held at the conclusion of Public and Councilmember Comments. Public Comment: Persons may speak on the Consent Agenda and Agenda Item 1 None CONSENT AGENDA (Items placed on the Consent Agenda are considered routine in nature and are considered non -controversial. The Consent Agenda can be acted upon in one motion. A consensus of the Council is required to remove any item for discussion and separate action.) Minutes --August 30, 2022 A. Approval of the August 23, 2022, City Council Meeting Minutes B. Authorize the Interim City Manager to execute Change Order No. 1, accept maintenance and authorize final payment to Gulf Coast, a CRH Company for the Spindletop Avenue Roadway and Drainage Rehabilitation Project — Resolution 22-206 C. Approve a resolution accepting maintenance of the lift station, water, and sanitary sewer improvements in Beaumont Eastex Subdivision Phase 1 - Resolution 22-207 D. Authorize the acceptance of a 0.3440-acre exclusive Drainage Easement located at 11450 Eastex Freeway and Broadoak Street - Resolution 22-208 E. Authorize the Interim City Manager to execute all related documents for the purchase of a 5' x 50' wide sidewalk easement for the Washington Blvd Phase 2 Project - Resolution 22-209 F. Authorize the Interim City Manager to execute all related documents for the purchase of a 5' x 50' wide sidewalk easement for the Washington Blvd Phase 2 Project - Resolution 22-210 Councilmember Neild moved to approve the Consent Agenda. Councilmember Durio seconded the motion. AYES: MAYOR MOUTON, MAYOR PRO TEM DURIO, COUNCILMEMBERS GETZ, TURNER, FELDSCHAU, SAMUEL AND NEILD NAYS: NONE MOTION PASSED WORK SESSION * Review and discuss the proposed FY 2023 Budget and Capital Program Chris Boone, Interim City Manager reviewed and discussed the proposed FY 2023 Budget and Capital Program. Mr. Boone stated that in the General Fund the total revenue for FY 2023 is $145,292,400 and the total expenditures is $145,612,400. The ending fund balance estimate for FY 2022 is $47,980,942 and for FY 2023 it will be $43,437,842. There was discussion regarding the ARP allocations for FY 2022 and FY 2023. The Water and Sewer ending fund balance for FY 2022 is $11,568,919 and the ending fund balance for FY 2023 will be $9,833,919. There will be a rate increase for water, sewer, and garbage from $20.75 to $22.25. The Capital Reserve Fund was discussed with an estimated beginning fund balance for FY 2022, in the amount of $6,951,051 and ending balance in FY 2023 in the amount of $9,402,951, the ending estimated fund balance for FY 2022 in the amount of $9,402,951 and the ending fund balance for FY 2023 will be $1,001,151. Water Projects and Sewer Projects were discussed along with Collier's Ferry Pump Station and the Raw Water Transmission Line, the Pine St., SWTP Chlorine Dioxide Pretreatment, Water Resiliency, Asphalt Street Rehabilitation, Concrete Street Rehabilitation, Pavement Preservation, Ditching Rehabilitation, and the General Improvement Projects. Minutes —August 30, 2022 JOINT PUBLIC HEARING Receive comments on the proposed FY 2023 Budget and the proposed 2023 Capital Program Public Hearing Open: 4:13 p.m. David Haskett 1765 Rikisha Ln. Beaumont TX Commented on the street and water project, noticed that both were separate in the Capital Plan, also commented on several streets and the patching that's being done in Old Towne, stated that instead of patching, the streets need to be redone because patching is tearing up the streets, made additional comments regarding the water lines, also asked that Council not go down on the tax rate, and to leave it at 59.5 instead of the original 58.5 that was proposed Jason Apodaca 6885 Pinkstaff Ln. Beaumont TX Stated that he's representing United Way North Beaumont and Jefferson County, informed Council as to what United Way does, stated that United Ways ask is great and the need in the city is great, made comments regarding the American Rescue Fund, in the first round of $16 million it was regulated that non -profits couldn't go after any of the funds, in the second round non -profits are allowed to go after the funds, United Way is asking for $2 million out of the American Rescue Fund, stated that United Way will be using the funds to continue to do what United Way is doing now, their need is great in Jefferson County Charles Crabbe 928 East Drive Beaumont TX Stated that he would like to see different cost for the city where they are picking up limbs etc., the city should charge homeowners for having items such as those removed, had questions regarding the Pine St. pipe, would like to see the taxes stay at the same amount and would like to see the water bill reflect the actual cost of water and sewer and if an item needs to be added for any other expenses Public Hearing Close: 4:26 p.m. AGENDA 1. Consider a resolution postponing the final vote on the proposed FY 2023 Budget to September 13, 2022. The proposed FY 2023 Budget was submitted to Council on August 9, 2022, and a work session was held on august 16, 2022. The proposed 2023 Capital Program was originally submitted on May 10, 2022, and again with the proposed budget on August 9, 2022, The notice of the public hearings on the Budget and Capital Program were published on August 20, 2022. Local Government Code, Section 102.007 states that at the conclusion of the public hearing, the governing body of the municipality shall take action on the proposed budget. Council should take action to postpone the final vote on the proposed budget until September 13, 2022. Minutes — August 30, 2022 Hold the Joint Public Hearing. Councilmember Getz moved to APPROVE A RESOLUTION THAT THE FINAL CITY COUNCIL VOTE TO ADOPT THE FY 2023 BUDGET BE AND HEREBY IS POSTPONED UNTIL SEPTEMBER 13, 2022, AFTER THE: PUBLIC HEARING ON THE PROPOSED TAX RATE. Councilmember Samuel seconded the motion. AYES: MAYOR MOUTON, MAYOR PRO TEM DURIO, COUNCILMEMBERS GETZ, TURNER, FELDSCHAU, SAMUEL AND NEILD NAYS: NONE MOTION PASSED Resolution 22-211 COMMENTS Public Comments (Persons are limited to three minutes) David Pete 6355 Chinn Ln. Beaumont TX Spoke to Council regarding the Proposed Budget, stated that he had a concern about the conversation regarding a dog park in the West End and how Council is allowing someone to put that on the agenda to propose a $450,000.00 dog park versus what this city really needs which is a community center for the kids, nothing has been presented as part of the proposed budget dealing with anything for the kids, you have a host of items in the fiscal budget that was put out last year with a list of different projects, citizens don't know what will get budgeted and what will not, discussed the drainage issues and how will the drains be maintained, commented on the Community Advisory Board Charles Crabbe 928 East Dr. Beaumont TX Thanked Chris Boone for his service as Interim City Manager, stated that the money should be raised for the dog park, thanked Council for their service Addle Allen 9695 Gross St. Beaumont TX Commented on the budget as well as the ditching in the Amelia area and the issues that they are having with standing water, the standing water is now causing mosquitoes, also stated that the stop signs have grass growing up the signs, this needs to be taken care of, commented on the kids walking in the street, there's a need for sidewalks, also has a problem with water backing up in her bath tub every time it rains and Council is wanting to raise rates, asked about the maintenance David Haskett 1765 Rikisha Ln. Beaumont TX Stated that he's been sitting in the meeting for 3 hours and still isn't clear as to whether Council approved the tax rate at 68.5% or 69.5%, wanted to know what the citizens will get for the one cents difference, he's confused as to what will be going to the deficit Minutes — August 30, 2022 Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS MAYOR PRO TEM DURIO - EXTENDED HIS CONDOLENCES TO THE NEILD FAMILY, THANKED MIKE HARRIS FOR SPEAKING AT THE PEAR ORCHARD NEIGHBORHOOD ASSOCIATION MEETING, HE DID AN EXCELLENT JOB COUNCILMEMBER GETZ - GAVE CONDOLENCES TO COUNCILMEMBER NEILD AND HIS FAMILY ON THE LOSS OF HIS UNCLE BILL NEILD, STATED THAT ON LAST FISCAL YEAR THERE WAS SOMETHING IN THE CAPITAL PLAN REGARDING DOG PARKS IN THE AMOUNT OF $450,000.00, THAT AMOUNT WAS FOR FOUR DOG PARKS, THE PROJECTED COST FOR ONE DOG PARK COST AROUND $125,000.00, WANTED TO CORRECT THE MISINFORMATION THAT WAS PROVIDED EARLIER, STATED THAT THE WORK THAT WAS DONE HERE TODAY WAS TAKEN SERIOUSLY BY ALL, THANKED STAFF FOR ALL THE HARD WORK THAT WAS PUT INTO PREPARING THE BUDGET COUNCILMEMBER TURNER - STATED TO CHRIS BOONE THAT THIS WOULD BE HIS LAST MEETING AS THE INTERIM CITY MANAGER, THANKED HIM FOR THE EXPERIENCE AND LOOKING FORWARD TO WORKING WITH HIM 1N THE FUTURE, THANKED TODD SIMONEAUX, CFO, IT'S HIS FIRST TIME GOING THROUGH THE BUDGET PROCESS AND HAD A LOT OF QUESTIONS, THANKED THOSE THAT ATTENDED THE MEETING ON TODAY COUNCILMEMBER FELDSCHAU - GAVE CONDOLENCES TO COUNCILMEMBER NEILD AND HIS FAMILY ON THE LASS OF HIS UNCLE,, THANKED TODD SIMONEAUX AND STAFF FOR ALL THE HARD WORK ON THE BUDGET, THANKED CHRIS BOONE, INTERIM CITY MANAGER FOR ALL THE WORK THAT HE'S DONE AS INTERIM MANAGER COUNCILMEMBER SAMUEL - EXTENDED HIS CONDOLENCES TO THE NEILD FAMILY, THANKED CHRIS BOONE FOR THE JOB THAT HE'S DONE AS INTERIM CITY MANAGER, APPRECIATES ALL THE STAFF FOR ALL OF THE HOURS THAT WAS SPENT PREPARING THE BUDGET COUNCILMEMBER NEILD - THANKED EVERYONE FOR THE CONDOLENCES FOR HIS UNCLE BILL, HE WAS INDEED A FINE MAN AND LOVED THIS CITY, THANKED CHRIS BOONE FOR THE JOB HE DID AS INTERIM CITY MANAGER, COULDN'T THINK OF A BETTER MAN FOR THE JOB, THANKED TODD SIMONEAUX, CFO FOR THE GREAT JOB HE AND STAFF DID PREPARING THE BUDGET CITY ATTORNEY REED - GRATITUDE TO CHRIS BOONE ON THE GREAT JOB HE DID AS THE INTERIM CITY MANAGER AND CONDOLENCES TO COUNCILMEMBER NEILD Minutes —August 30, 2022 PUBLIC WORKS DIR.
