HomeMy WebLinkAbout5-2-96 BA Minutes*MINUTES* BOAVx,D O1106V#S`OMENT May 2,1996 City Council Chambers A meeting of the Board of Adjustment was held on May 2, 1996 with the following members present: Board Member Kevin Fuller Board Member Bob Harris Board Member Mary Jowers Board Member Chuck Mason Board Members Absent: Board Member Dohn LaBiche Also present: Stephen Richardson, Planning Director; Murray Duren, Senior Planner; Tyrone Cooper, First Assistant City Attorney; and Jill Cole, Recording Secretary. APPROVAL OF MINUTES Board Member Mason made a motion to approve the minutes of the April 4, 1996 Board of Adjustment Public Hearing. Board Member Harris seconded the motion. Motion to approve carried 4:0. SWEARING IN OF WITNESSES 1) File #381-BA: A request for a variance requirements for a two-story addition to a Family Dwelling) District. Location: East 1/2 acre of Lot or Block 21, Subdivision), 350 Iowa Street Applicant: Jerry L. Carnley, Jr. of two feet from the 7-1/2' side yard residence in an RS (Residential Single E1 ll 12 111 1 3 r 111221!�111111 1 Mr. Richardson told the Board that the variance request from the side yard setback was from 7.5 feet to 5.5 feet. The applicant is adding an additional 2,666 sq. ft. of living space to the rear of an existing house that he is renovating. In February, 1996, he received a building permit for "repairs to residence". He did not submit any building plans or site plan. He was BOARD OF ADJUSTMENT May 211996 Public Hearing given a stop work order on the addition. The original house and the house of the neighbor to the east are 20' apart. The addition sits behind and beyond the neighbor's house. The nearest structure located east of the addition is a detached one -car garage located about 30 feet east of the property line. Staff feels that the request adequately meets the three conditions for approval; therefore, Mr. Richardson recommended approval of the request. Thirty-nine notices were sent to property owners within 200 feet of the subject property. One response in favor and one in opposition were returned. In response to a question from Board Member Fuller, Mr. Richardson said that no response was received from the neighbor to the east of the subject property. The response in opposition was from the neighbor across the street. Board Member Harris asked if it was normal procedure to be able to obtain a building permit without a site plan. Don Burrell, the newly appointed building official, discussed the normal procedures followed in his office regarding applications for additions and for renovations only. Board Member Jowers, acting as chairman, opened the public hearing and asked for the applicant's comments. Mr. Carnley addressed the Board. He said he made two trips to the city to see a building official about his plans, but was only able to talk to a clerk who was not very helpful. The clerk sold him the permit. No further comments were made. Board Member Jowers closed the public hearing. Board Member Harris made a motion to approve the variance request of File 381-BA as submitted. Board Member Mason seconded the motion. Motion to approve carried 4:0.
