Richardson, Planning Director SUBJECT: Request for a special exception from the sign regulations which require that the structural support for an owner identification sign in the GC -MD District be set back from the property line a minimum distance of 10 feet. (Allowed by Section 30-37 E,2. from regulations of Section 30-28 (c) 3.) FILE: 395-BA STAFF REPORT AND PROJECT INFORMATION The Planning Director recommends approval of the special exception because the required conditions have been complied with by the applicant. The hospital wishes to place a sign on a pole at the northeast corner of North and 14th Street. The 9'x 8'sign, 21'in height, will show the location of the new "Minor Care Center". The hospital wishes to set the pole for the 72 sq. ft. sign IV' from the property line which is the North Street right-of-way line. The City Council, on February 18, 1997, executed a License to Encroach Agreement with St. Elizabeth Hospital allowing the proposed face of the subject sign to encroach 3' into the North Street right-of-way, subject to the granting of a variance or special exception of the setback for the supporting pole. Another License to Encroach granted in 1996 by the City Council allowed a building encroachment of from Tto 4'for a 52-1/2'strip along 14th Street for the clinic. Also in 1996 a variance for the North Street elevator shaft leading to the helicopter landing pad on top of the parking garage was granted by the Board of Adjustment, allowing a setback of 13' instead of the required 20'. North Street - 2980 North St. St. Elizabeth Hospital Beaumont, Texas St. Elizabeth Hospital is submitting a request for special exception to construct a sign as described above for the following reasons. It is critical that patients approaching this area have a clear view of signage that identifies both Emergency Services and Minor Care. This will enable the patient to self triage and quickly make a decision as to where they need to go for medical assistance. Because of the size and structure of the building, the view of the sign would be restricted if placed in the location dictated by code. If allowed to place the sign post V 6" inside the right-of-way, the sign visibility will be maximized without obstructing public access or line -of -sight at the intersection. North is "used" in this area as a collector street. Fourteenth Street is a 60' residential right-of-way with a 26'wide pavement. DRAINAGE: There is a 21 " storm sewer in North and an 18 " line in 14th Street. GENERAL INFORMATION/PUBLIC UTILITIES continued WATER: There is an 8" water main in North and a 6" line in 14th Street. SANITARY SEWER There are 18" sanitary sewers in North and 14th SERVICE: Streets. FIRE PROTECTION: Fire protection is provided by Station #7, 1700 McFaddin Avenue. ADEQUACY OF SERVICE: Services and utilities are adequate. RE QUIRE MENTS FOR A SPECIAL EXCEPTION The Board of Adjustment has the power to grant certain special exceptions to the Zoning Ordinance if special conditions exist which may justify a deviation from the requirements of the ordinance. If the request is in compliance with one of the nine reasons for granting a special exception, then the applicant must then demonstrate that the exception will not adversely affect the value and use of adjacent or neighboring property or be contrary to the best public interest. The application does meet the first requirement. The property on which the setback or yard exception is requested is a corner lot. The adjacent and neighboring property is part of the greater St. Elizabeth Hospital complex and all of the adjacent land on the four corners of the intersection is owned by the Sisters of Charity. Therefore, the value and use of neighboring properties is not an issue in this instance. The size and location of the sign is to aid the patients in locating exactly where to go for various kinds of medical treatment available at or very near the intersection of North and 14th Streets. In addition to the minor care clinic at the northeast corner, the cancer clinic, emergency room, offices and other St. Elizabeth Hospital facilities are situated nearby. Because of previous construction on the building and as a result of a prior building setback variance and a License to Encroach, visibility of the sign directing patients to the Minor Care Clinic would be obscured or vague if the sign is set back Was required. This intersection is a high traffic area, including emergency vehicles, normal traffic and heavy pedestrian use. The bottom of the sign face will be at a 12' height above grade and will not interfere with vehicular traffic. Fourteenth Street and North Street allow two-way traffic. The sign will lie 16' 8" east of 14th Street. Granting of the special exception will be in the public interest.
