Richardson, Planning Director SUBJECT: Request for a variance of the maximum height requirement for an owner identification sign proposed in an LI (Light Industrial) District at 2265 IH-10 South. (Section 30-28 (c) 3). The variance is from 50 feet to 80 feet. STAFF REPORT Chandler Signs, Inc., the applicant, is requesting a variance of the height requirement for a joint owner identification sign for two new Marriott hotels (Courtyard and Fairfield Inn) under construction in the 2200 block of IH-10 South. In an LI (Light Industrial) District, an owner identification sign may not be greater than 50 feet in height. This dimension is measured from the crown of the roadway immediately abutting the property. The subject tract abuts the northbound service road of IH-10 South. The proposed sign is 80 feet tall. The applicant states that a 50 foot sign cannot be seen by motorists on the highway. They cite that trees will block the view of the sign. The applicant shall have the burden of proof to demonstrate that all three of the conditions for granting a variance have been met. Signage to identify i both hotels would not be visible from the Interstate at the maximum overall height of 50' as stipulated by the ordnance. The site has been target tested by our company and the minimum overall height needed is 80 feet. Otherwise, the sign will not be seen by motorists on I.H. 10. We intend to utilize one structure to identify both hotels to prevent sip clutter. ' Let us know if you have any questions or need anything else. We will be looking forward to our hearing on May 7th. Indicate how your application meets each of these conditions in the space following each condition. (The applicant has the burden of proof to demonstrate that all three of the conditions necessary for a variance have been met). Except as otherwise prohibited, the Board is empowered to authorize a variance from a requirement of the Zoning Ordinance when the Board finds that all of the following conditions have been met: CONDITION A: That the granting of the variance will not be contrary to the public interest. Granting of the variance would not have any effect on the value of or the use of the surrounding property. In fact it would be more convenient for the public to find their way to the property. CONDITION B: That literal enforcement of the ordinance will result in unnecessary hardship because of exceptional narrowness, shallowness, shape topography or other extraordinary or exceptional physical situation or physical condition unique to the specific piece of property in question. "Unnecessary hardship" shall mean physical hardship relating to the property itself as distinguished from a hardship relating to convenience, financial considerations or caprice, and the hardship must not result from the applicant or owner's own actions. There are several trees that will block the view of the sign at the 50' maximum height stipulated by the sign ordinance. The sign at 80.1 overall height will be visible to the motoring public. CONDITION C: That by granting the variance, the spirit of the ordinance will be observed and substantial justice will be done. The only exception to the ordinance we are seeking is the height limit.
