HomeMy WebLinkAbout1-2-03 BA Minutes*MINUTES* BOARD OF ADJUSTMENT January 2, 2003 City Council Chambers A meeting of the Board of Adjustment was held on January 2, 2003 at 3:00 p.m. with the following members present: Chairman Bob Harris - Board Member Mary Jowers Board Member Georgine Guillory Alternate Member Joey Hilliard Alternate Member Gladys Allen Board Members absent: Board Member Dohn LaBiche Board Member Lamar Roach Also present: Stephen Richardson, Planning Manager; Tyrone Cooper, First Assistant City Attorney; Jill Cole, Recording Secretary; Adina Abshire, Planner; Cheryl Robinson, Senior Planner APPROVAL OF MINUTES Alternate Member Allen made a motion to approve the minutes of the December 5, 2002 Public Hearing. Board Member Jowers seconded the motion. Motion to approve carried 4:0. SWEARING IN OF WITNESSES F0e 488-BA: A request for a special exception to the parking requirements. Y/Ocation: 2205 Laurel Applicant: Mr. and Mrs. Willie Carter, Sr. (Alternate Member Hilliard arrived.) BOARD OF ADJUSTMENT January 2,100— . - Mr. Richardson stated that Mr. and Mrs. Willie Carter, owners of Jazzy's 11, were given a specific use permit by City Council in September, 2002 to operate this retail business in a building that formerly housed a property management office at 2205 Laurel. This approval was subject to receiving a special exception to the parking requirements. Jazzy's 11 occupies the front half of the building which consists of two floors. A cabinet maker occupies the space in the rear. When the property management office occupied the building, ten parking spaces were required. There are 11 spaces provided. Due to the fact that the current use is a retail use, the requirement is one space per 200 square feet, which would be 36 spaces. The Board of Adjustment may grant a special exception when the Board finds that such special exception will not adversely affect the value and use of adjacent or neighboring properties or be contrary to the public interest. The Board of Adjustment may waive or reduce off-street parking and loading requirements when it finds the same are unnecessary for the proposed use of the building or structure for which the special exception request applies. Twenty-two notices were mailed to property owners within 200 feet. No responses in favor or in opposition were returned to staff. Slides of the subject property were shown. Chairman Harris opened the public hearing and asked for the applicant's comments. Sandra Carter, the applicant, addressed the Board. She said that there was never a parking problem at the business. Chairman Harris asked for comments in favor or in opposition. Willie Carter, Jr. addressed the Board in favor of the request. Leon Chambers addressed the Board in favor of the request. Mr. Chambers has an office in the subject building and said he has never had a problem with parking. Willie Carter, Sr. addressed the Board in favor of the request. Sandra Carter's mother addressed the Board in favor of the request. N BOARD OF ADJUSTMENT IAAUMY 2 The public hearing was closed. Discussion between the Board members followed. Board Member Guillory made a motion to approve a special exception to the parking requirements at 2205 Laurel as requested in File 488-BA. Board Member Jowers seconded the motion. The vote on the motion to approve File 488-BA follows: Chairman Harris - For Board Member Jowers - For Board Member Guillory - For Alternate Member Hilliard - For Alternate Member Allen - For The motion to approve File 488-BA carried 5:0. OTHER BUSINESS THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED AT 3:25 P. M. 3
