HomeMy WebLinkAbout8-7-03 BA Minutes*MINUTES* BOARD OF ADJUSTMENT August 7, 2003 City Council Chambers A meeting of the Board of Adjustment was held on August 7, 2003 and called to order at 3:00 p.m. with the following members present: Board Member Mary Jowers Board Member Dana Timaeus Alternate Member Justin Howard Alternate Member Sam Pullig -/ Board Members absent: Chairman Bob Harris-/ Board Member Joey Hilliard/ Board Member Pat Avery/ Alternate Member Gladys Allen Also present: Stephen Richardson, Planning Manager; Tyrone Cooper, First Assistant City Attorney; Jill Cole, Recording Secretary; Adina Abshire, Planner APPROVAL OF MINUTES Alternate Member Pullig made a motion to approve the minutes of the July 3, 2003 Meeting. Board Member Timaeus seconded the motion. Motion to approve carried 4:0. SWEARING IN OF WITNESSES PUBLIC HEARING 1) Fite 502-BA: A request for variances to the minimum front yard setback of 40' to 33' and to the minimum side yard setbacks of 25' to 15'. Location: Southeast corner of Lincoln and Hemlock Applicant: Joseph Durousseau, Jr. BOARD OF ADJUSTMENT August 7, 2003 Mr. Richardson stated that the subject property is zoned Light Industrial. City Council just recently rezoned it to LI. The lot size is 60' x 118'. To build the proposed welding shop on this property and meet the required setbacks would allow a 10' x 53' building. Mr. Durousseau, the applicant, submitted two proposals: I) 30' x 60' building with a front setback of 33' and 15' side yards 2) 30' x 53' building with a front setback of 40' and 15' side yards. The front setback in a Light Industrial district is 40' and the applicant would be required to have 25' side yard setbacks under normal circumstances. The applicant shall have the burden of proof to demonstrate that all three conditions necessary for a variance have been met. Eighteen notices were mailed to property owners within 200 feet. No responses in favor or in opposition were returned to staff. Slides of the subject property were shown. Discussion followed between Mr. Richardson and the Board regarding setbacks. Board Member lowers, acting as Chairperson, opened the public hearing and asked for the applicant's comments. Joe Durousseau, the applicant, addressed the Board. Board Member Jowers asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Discussion followed between Board members. Alternate Member Pullig made a motion to approve a 30' x 53' building with a front setback of 40'. and a variance to the minimum side yard setbacks of 25' to 15' for the property at the southeast corner of Lincoln and Hemlock as requested in File 502-BA. Alternate Member Howard seconded the motion. The motion to approve File 502-BA carried 4:0.
