Richardson, Planning Manager SUBJECT: Request for a variance to the minimum rear yard setback from 25' to 6' 8" for an addition to a house. STAFF REPORT Laurence Laserna is requesting a variance to the minimum setback requirement from 25' to 6' 8" for an addition on the rear of his house at 5090 Ada. Mr. Laserna states that lie would like to have a 1,200 +/- sq. ft. addition constructed on the rear because it is the only viable location and option due to less construction costs and to strengthen the existing foundation and structures at the back of the house with storm clips/tie straps installed to all trusses and rafters. The applicant shall have the burden of proof to demonstrate that all three conditions necessary for the approval of a variance have been met. Exhibits are attached. The now addition at the back of the existing residence which is W-8" away from property line will not be contrary and/or affect to the public interest and safety. No existing utilities easement located at the back of property line. The new addition is 26'-0'-' away from the road, easily accessible from existing driveway, no obstructions from the road, 27 feet way from my neighbor's free standing two cars garage and tie-in to existing sanitary sewer is located at the back of the house. This is the only viable location and option to construct the now addition due to less construction costs and strengthen the existing foundation and structures at the back of the house with wind storm clips/tie straps installed to all trusses and rafters. Due to physical location and condition of existing house and the now addition in corner between Ada Avenue and Mayhaw Drive, the spirit of the ordinance is still, be there and be observed because it will not affect and endanger the welfare, health and safety of the public.
