Richardson, Planning Manager SUBJECT: Request for a variance to the minimum rear yard building setback from 15' to 2' 6". FILE: 531-BA STAFF REPORT Jason Tyner, the property owner, is requesting a variance to the minimum rear yard building setback to allow the construction of an open pool pavilion at 2245 Turningleaf. Mr. Tyner is constructing a swimming pool in his backyard. As part of this construction, he would also like to construct a pool pavilion that will connect to the house and an existing covered patio. The edge of the pavilion will be 2' 6" from the property line. The rear of the property backs up to the 170' wide DD#6 right-of-way and Hillebrandt Bayou along its west side. Along the property=s south side, is the 75' wide DD#6 Ditch No. 122 easement. The applicant shall have the burden of proof to demonstrate that all three conditions necessary for a variance have been met. Exhibits are attached.
