HomeMy WebLinkAbout4-7-05 BA Minutes*MINUTES* BOARD OF ADJUSTMENT April 7, 2005 City Council Chambers A meeting of the Board of Adjustment was held on April 7, 2005 and called to order at 3: 00 p.m. with the following members present: Chairman Bob Harris Vice Chairman Mary .lowers Board Member Pat Avery Board Member Dana Timaeus Board Member Joey Hilliard Alternate Member Gladys Allen Board Members absent: Alternate Member Sam Pullig Alternate Member Justin Howard Alternate Member Kelli Maness Also present: Stephen Richardson, Planning Manager; Jill Cole, Recording Secretary; Adina Abshire, Planner; Joe Sanders, Senior Assistant City Attorney APPROVAL OF MINUTES Vice -Chairman Jowers made a motion to approve the minutes of the March 3, 2005 Meeting. Board Member Hilliard seconded the motion. Motion to approve carried 5:0, PUBLIC HEARING 1) File 536-BA: A request for a variance to the minimum side yard building setback from 10' to 7.75'. Location: 6095 Calder Applicant: Harold Smalley Mr. Richardson presented the staff report. The applicants, Mr. and Mrs. Harold Smalley, are requesting this variance to allow the addition on the west side of their home at 6095 Calder. The addition will be used for storage and a spa. BOARD OF ADJUSTMENT ApTil 7, 2005 The applicants state that the interior layout of the home dictates that the addition be positioned where proposed. It will be aligned with the angle of the house. The addition will be located behind a permanent, brick column fence and will be located 26.25' from the edge of the pavement of Langham. The site plan shows water and electrical lines along the west property line. Neither Water Utilities or Entergy have a problem with the request. The applicant shall have the burden of proof to demonstrate that all three conditions necessary for a variance have been met. Nineteen notices were mailed to property owners within 200'. Three responses in favor and none in opposition were received. Slides of the subject property were shown, Chairman Harris opened the public hearing and asked for the applicant's continents. Harold Smalley, the applicant, addressed the Board. Mr. Smalley stated that the original project was just a patio and was begun on a weekend and expanded from there and that is why no permit was issued. Chairman Harris asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Discussion between the Board followed. Board Member Hilliard made a motion to approve a variance to the minimum side yard building setback from 10' to 7,75' at 6095 Calder as requested in File 536-BA. Board Member Jowers seconded the motion. The vote on the motion to approve File 536-BA follows: Chairman Harris - For Vice Chairman Jowers - For Board Member Avery -For Board Member Hilliard - For Board Member Tirnaeus - For The motion to approve File 536-BA carried 5:0. THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED AT 3:20 P. M.
