HomeMy WebLinkAbout6-2-05 BA Minutes*MINUTES* BOARD OF ADJUSTMENT June 2, 2005 City Council Chambers A meeting of the Board of Adjustment was held on June 2, 2005 and called to order at 3:00 p.m. with the following members present: Chairman Bob Harris Vice Chairman Mary Jowers Board Member Pat Avery Alternate Member Sam Pullig Alternate Member Kelli Maness Board Members absent: Board Member Dana Timaeus Board Member Joey Hilliard Alternate Member Gladys Allen Alternate Member Justin Howard Also present: Steve Richardson, Planning Manager; Adina Abshire, Planner; Jill Cole, Recording Secretary; Joe Sanders, Senior Assistant City Attorney; Tyrone Cooper, City Attorney Vice Chairman Jowers made a motion to approve the minutes of the May 5, 2005 Meeting. Board Member Avery seconded the motion. Motion to approve carried 4:0. SWEARING IN OF WITNESSES PUBLIC HEARING 1) File 537-BA: A request for special exceptions to the minimum setback requirement for two signs from 20' to 0' and from 10' to 0'. Location: 1120 Longfellow Applicant: R. J. Broussard, DDS Mr. Richardson presented the staff report. The signs on Longfellow and IH-10 are proposed to be constructed at the property line. BOARD OF ADJUSTMENT JLIIIC 2, 2005 The Zoning Ordinance allows for special exceptions when a structure existing at the effective date of this ordinance precludes locating an owner identification sign in compliance with (fie setback requirements and the Board finds that such special exception will not adversely affect the value and use of adjacent or neighboring property or be contrary to the public interest. Ten notices were mailed to property owners within 200'. No responses in favor or in opposition were received. Slides of the subject property were shown. (Alternate Member Maness arrived.) Discussion followed between Mr. Richardson and the Board. Chairman Harris opened the public hearing and asked for the applicant's continents. Jeff Gibbens of General Design Sign Company, representative for Dr. Broussard, addressed the Board. Chairman Harris asked for comments in favor or in opposition. 1121 "MM-11MMIR The public hearing was closed. Discussion between the Board members followed, Alternate Member Pullig made a motion to approve a request for special exceptions to the minimum setback requirement for two signs from 20' to 0' and from 10' to 0' at 1120 Longfellow as requested in File 537-BA. Vice -Chairman Jowers seconded the motion. The vote on the motion to approve File 537-BA follows: Chairman Harris - For Vice -Chairman Jowers - For Board Member Avery - For Alternate Member Pullig - For Alternate Member Maness - For The motion to table File 537-BA carried 5:0. 2) File 539-BA: A request for variances to the minimum side yard setback from 7 1/2' to 2 1/2 ' and to the minimum rear yard setback from 15' to 11'. Location: 4845 Littlewood Applicant: David Bourquein BOARD OF ADJUSTMENT June 2, 200i Mr. Richardson presented (lie staff report. David Bourquein would like to add a second story to an existing garage and connect the garage to the house with an elevated enclosed walkway. The second story of the garage will consist of two bedrooms and a television room. The original garage was built to within 2 1/2'of the side yard setback and to within I P of the rear yard setback. Now that a second story is being added a 7 1/2'side yard setback and a 15' rear yard setback are required. The applicant sliall have the burden of proof to demonstrate that all three conditions necessary for approval of a variance have been met. Eighteen notices were mailed to property owners within 200 feet. One response in favor and two in opposition were returned. Slides of the property were shown, Chairman Harris opened the public hearing and asked for the applicant's comments. The applicant, David Bourquein, addressed the Board and answered questions. Mike Jenkins, builder of the proposed addition, addressed the Board. Chairman Harris asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Discussion followed between the Board members. Alternate Member Pullig made a motion to approve a request for variances to the minimum side yard setback from 7 1/2'to 2 1/2'and to the minimum rear yard setback from 15' to I I' at 4845 Littlewood as requested in File 539-BA. Board Member Avery seconded the motion. The vote on the motion to approve File 539-BA follows: Chairman Harris - Against Vice -Chairman Jowers - Against Board Member Avery - For Alternate Member Pullig - For Alternate Member Maness - For The motion to approve File 539-BA failed 3:2. 00194f THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED AT 3:50 P.
