REPORT CASE+ 330BA DATE: January 26, 1988 FROM: Planning Division/Community Development Department REQUESTED ACTION: Consider a variance or a special exception to reduce the front ten foot setback for a sign to five foot at 195 IH- 10 N. The staff recommends approval of a special exception to reduce the required front yard setback from 10-feet to 5-feet for the following reasons: The special exception will comply with condition 30- 37E.2.(b)(2) of the Zoning Ordinance which allows yard exceptions for comer lots; The special exception will not adversely affect the value and use of the adjacent or neighboring property; and, The special exception will not be contrary to the best public interest. x 79 r relu e k Gulf -Chevron demolished the existing service station located at the. corner of IH-lit N. and laurel and re built a new service station. Part of the new station design included two new owner identification signs. The old, highrise sign will remain. one of the new I.D. signs as proposed in the station plans cannot meet the ten foot setback requirements for conmercial signs in a heavy industrial zoning district. The sign now located at laurel and IH-10 is mounted on a single structural support or pole. The new design requires a double pole which, as proposed, encroaches five feet into the required setback or front yard area. The fact that the new sign is mounted on a double pole base and not a single pole was not indicated in the original building plans. Anderson, Acting Planning Director 14239 Sommern7eyer Houston, Texas 77041 (713) 690-6677 Re: Variance Application for Gulf/Chevron Station at 110 & Laurel Dear Mr. Anderson, Please accept this application that I have enclosed in order to meet the application date of December 21 and to be put on the agenda of the City Council to occur on January 7', 1988 at 2:00 P.M. in your City Council chambers. Acting as the contractor for Culf/Chevron, it is our desire to locate an ID/Price Sign in the same location (corner of Laurel & I10 feeder road) where the existing single pole Gulf disc is located. The reason for the variance required is that with Chevron's new identity program that should occur in the near future, the new sign structures call for a two -pole installation. The width of the signage will not exceed what has already been installed, but because it is a two -pole structure, the pole closest to the feeder street encroaches on the limits set by the Sign Administration. As we understand the ruling now, it is necessary to remain 10' behind the property line with any foundation. Our variance request is to allow us to encroach upon this area, allowing us to be 5' from the property line. Please find outlined below our responses to conditions A, B, & C of your variance application. Condition A: It is our feeling that the granting of the variance will not be contrary to the public interest in that the sign will not exceed the size of the sign that is existing, but instead will enhance the: appearance by all new signage and new sign structure. Condition B: The literal enforcement of the ordinance would cause Gulf/Chevron to have this station not come into standards of its new signage program. The station has gone through a complete remodel, resulting in a great expense to achieve a pleasing and serviceable appearance to their customers and the community. Additionally, the utilization of this new sign structure will enhance the appearance of the: corner of the property and complete the total signage program for this type of station. To relocate the sign 10' from the property line would cause the entry area from Laurel Street to be critically cut and affect the traffic flow from the street onto the side street. Page 2 City of Beaumont December 17, 1987 Condition C: Granting the variance does not conflict the spirit of the ordinance because the signage that is existing will not be increased in size with this new sign installation. The only effect would be moving from a single pole installation to a double pole installation and would match in construction the similar situation that exists in the Texaco station directly across the street. W.= RIGHT OF WAY CASE #7 330-BA CONDI"'FIONS OF SPECIAl- APPROVAL- FOR EXCEPTIONS Special Exceptions may be granted in the following situations: a) To reconstruct, extend or enlarge a building occupied by a nonconforming use on the lot or tract occupied by such building, provided that the reconstruc- tion, extension,, or enlargement does not prevent the return of the property to a conforming use. b) To deviate yard requirements in the following circumstances: 1) An exception front the front yard requirements where the actual front yard setback of an abutting lot does not meet the front yard requirement or a rear yard exception where- the actual rear yard setback of any four (4) or more lots in the same block do not meet the rear yard requirements of these regulations. 3) An exception where the existing front yard setbacks of the various lots in the same block are not uniform, so that any one of the existing front yard setbacks shall, for a building hereafter constructed or extended, be the required minimum. front yard depth. 4) An exception from the iiiinimum front yard requirements for owner identifi- cation signs where a structure existing at the effective date of this Chapter precludes locating a sign in compliance with the setback regula- tion. 5) An exception from a minimum interior side yard setback requirement for owner identification signs for existing businesses which were developed prior to April. 1, 1981, where there is no safe place to erect a sign in compliance with the luinimum, setback requirements. A condition for grant- ing of the exception is that the applicant must demonstrate that the sign shall.. riot screen or obstruct the view of an existing sign, building, or outdoor display area. 6) An exception from the minimum side yard setback requirement where a non- conforming building was in existence at the time of the passage of this ordinance. c) To waive or reduce off-street parking and loading requirements when the Board finds the saute are unnecessary for the proposed use of the building or struc- ture for which the special exception request applies. The Board of Adjustment may grant a Special Exception from the requirements of the Zoning Ordinance if the request dies with one of the conditions listed in the Zoning ordinance for special exceptions and if the Board finds that the special exception will not adversely affect the value and use of adjacent or neighboring property or be contrary to the best public interest. Section 30-37E.2. (b) (2) authorizes an exception on yard requirments for corner lots. The subject tract is a corner lot at the southwest corner of the intersection of Laurel. Avenue and the west service road of IH-10 N. (southbound) The application complies with conditions (b) (2); The special exception will not adversely affect the value and use of adjacent or neighboring property. The proposed sign will not black out from view next door properties or signs. The new sign will be placed approximately in the same location as the existing sign only it will contain two poles for support instead of one pole. This is to meet the marketing and signage requirements of the newly rebuilt and designed station by Chevron USA. This is part of the national changeover from Gulf to Chevron. • A special exception will not be contrary to the best public interest. The new curbs and driveways for the site have already been constructed. To set the sign 10-ft. back from the front property line would result in the second (westerly) pole support lying three feet into the driveway on laurel nearest the intersection. This would reduce the two-way entrance from 35-ft. to 32-ft. The drives have already been approved by Public Works. The sign is intended for southbound traffic on the service road. The existing high rise sign attracts the elevated traffic on the main highway. The sign, 28-ft. in height, will be physically setback from the curb of the interstate service road 20-ft. and 20-ft. setback from the Laurel Ave. curb. The sign will not obstruct traffic on either street.
