HomeMy WebLinkAbout321-BASTAFF REPORT CASE + 321-BA TO: BOARD OF ADJUSTMENT DATE: 4-30-87 FROM: PLANNING DIVISION/COMMUNITY DEVELOPMENT DEPARTMENT REQUESTED ACTION: Request for a special exception to reduce the required exterior side yard setback from ten (10) feet to five (5) feet for a building at 5085 College St. STAFF RECOMMENDATION The staff recommends approval of the special exception based on: • The applicant's compliance with the condition (b) (6) which allows yard exceptions for side lot lines; The adjacent and neighboring property will not be adversely affected, and, • The special exception will not be contrary to the public interest. CASE + 321-BA PROJECT INFORMATION Mr. Boyd Caffey of Caffey Automotive owns an automotive machine shop and parts business situated on a commercial tract which abutts College Street for 200-ft. and has frontage on Bdgemore Street for 104-ft. The existing building lies only 5-ft. from the property line along College Street. He is proposing an addition to the structure with dimensions of 51-ft. x 80-ft. The resulting building dimensions would be 131' x 801. The owner wishes to continue the 5-ft. setback to keep the side of the building uniform. Boyd Gaffey of CAFFEY AUTOMOTIVE, we are requesting an exception from the minimum side yard setback requirement. His present facility, located at 5085 College Street, was nonconforming at the time of this ordinance. The existing building at this location is 80' x 80'. We propose to add a 51' x 80' addition to the side of the building, making the overall building 131' x 80'. In attempting to keep the building lines uniform, we would like to continue the new addition in line with the existing building. The new addition and remodeling of part of the existing building will greatly enhance the valve and beautification of this property. Air. Caffey is limited to the amount space he can expand and we are trying to get the greatest amount of square footage possible. With this in mind, we would appreciate all considerations on his behalf. W.= RIGHT OF WAY CASE # 321-BA ANALYSIS The Board of Adjustment may grant a Special Exception from the requirements of the Zoning Ordinance if the request complies with one of the conditions listed in the Zoning Ordinance for special exceptions and if the Board finds that the special exception will not adversely affect the value and use of adjacent or neighboring property or be contrary to the best public interest. • Sec. 30--37.2.(b) (6) authorizes an exception from the minimum side yard setback requirements where a non -conforming building was in existence at the time of the adoption of the Ordinance. The existing building was constructed prior to the adoption of this Ordinance. The required exterior side yard setback is 10 feet. The building has a 5 foot setback which makes it a non -conforming building. The application complies with condition 6 for special exceptions. • The special exception will not adversely affect the value and use of adjacent or neighboring property. This proposal is for the expansion of the existing structure which lies on the northeast part of the tract. The addition will be added to the west side of the building away from the adjacent properties. There will be 69-ft. from the addition to Edgemore St. on the west side of the property and 20 feet to the south property line. • To deny the request would result in a particular hardship on the applicant while doing little to advance or protect the interests of the general public. The addition and resulting 5-ft. setback will not cause any traffic problems from the intersection of College and Edgemore. College is currently being widened to 33-ft. lanes. No additional right-of-way is required along the applicant's property. Finally, many buildings along College do not comply with the required setbacks. The exception will not be contrary to the public interest.
