PUBLIC HEARING
BOARD OF ADJUSTMENT
September 3, 1987
CITY COUNCIL CHAMBERS
CITY HALL, BEAUMONT, TEXAS
2:00 P.M.
A meeting of the Board of Adjustment was held on September 3, 1987 with the
following members present:
Chairman Milton Bell
Board Member Whit Outlaw
Board Member Ron Lanier
Board Member Charles Thompson
Board Member Gerald Farha
Board Member Bettye Smith
Board Member absent: Preston Shaw.
Also present: Kirt Anderson, Senior Planner/Landscape Architect; Tyrone
Cooper Assistant City Attorney; Walterine Brown, Recording Secretary.
APPROVAL OF MINUTES
Commissioner Smith made a motion to approve the minutes with the following
corrections on File 324-BA: Vote was 3 for and 2 against and Motion failed.
(Board needs four (4) to approve a special exception).
Seconded by Chairman Bell.
Vote carried 5-0.
FILE 326-BA. Request to vary the required 25-f t. front yard building setback
to 15-f t.; lot 3, Bayou Bend Addition; General location of subdivision is
south of Delaware St. at Crow Road.
The staff is recommending approval based on its compliance with the three
conditions I) it will not be contrary to the public interest 2) there is
a substantial unnecessary hardship in consideration 3) that the spirit of
the ordinance will be observed by granting the variance.
SPEAKING IN FAVOR OF THIS REQUEST

Commissioner Lanier made a motion to approve the variance based on it not
being contrary to the public interest, the literal enforcement of the ordinance
would result in a unnecessary hardship and that the spirit of the ordinance
r
will be observed.
Seconded by Member Thompson.
Vote carried 5--0.
FINAL REVIEW AND ADOPTION OF PROPOSED AMENDMENTS TO THE BYLAWS OF THE BOARD
OF ADJUSTMENT
Member Thompson made a motion to adopt the amendments to the Bylaws.
Seconded by Commissioner Farha.
Vote carried 6-0.
