Chairman Milton Bell Board Member Jayne Eisen Board Member Gerald Farha Board Member Ron Lanier Board Member Charles Thompson Board Member Bettye Smith Board Members absent: Whit Outlaw, Bill Lucas and Kevin Fuller. Also present: Kirt Anderson, Planning Director, Murray Duren, Sr. Planner, Carla Gigliotta, Recording Secretary and Ilona Baker, Drafting Technician. APPROVAL OF MINUTES Board Member Eisen made the motion to approve the minutes of the September 6, 1990 Public Hearing. Board Member Lanier seconded the motion. The motion to approve carried 6:0. APPROVAL OF 1991 CALENDAR Board Member Thompson made a motion to approve the Board of Adjustment 1991 Meeting Calendar. Motion was seconded by Board Member Eisen. Motion carried 5:0. BOARD OF ADJUSTMENT June 6, 1991 Public Hearing PUBLIC HEARING File #347-BA: Request for a special exception to reduce the front yard setback in an industrial zoned area. Applicant: Raymond Audilet. Location: 1075 Amelia Avenue. Staff recommended denial of the special exception for the following reasons: This request will adversely effect the value and use of neighboring property and the exception is contrary to the best public interest and the request does not comply with condition 30-37E(2)(b)(3). Thirteen notices were mailed to property owners within two -hundred feet of the subject property. Applicant presented waivers from two property owners who own three structures across the street from subject property. Speaking in Favor of this Request Raymond Audilet 6870 Glen Willow Beaumont, TX Eddie grader, Attorney 2499 Calder Avenue Beaumont, TX Speaking in Opposition of this Request Eddie Shamp 1140 Amelia Beaumont, TX (Departure of Board Member Eisen 2:45) Board Member Thompson made the motion to grant the special exception to comply with structures that already exist. The motion was seconded by Board Member Farha. Motion to grant the special exception failed by a lack of a majority vote. There were 2 votes in favor and 3 in opposition of the request. (Departure of Board Member Lanier 3:00) 7 BOARD OF ADJUSTMENT June 6, 1991 Public Hearing File 346-BA. Request for a special exception from the yard or setback requirements to allow front and exterior side yard exceptions for a corner lot. Applicant: St. Elizabeth Hospital Cancer Center. Location: S.E. Corner North and 14th Street. Staff recommended approval of the request, because, as a corner lot, it complies with conditions of Section 30-37E.2. (b) (2), the special exception will not adversely effect the value and use of adjacent or neighboring property and this request will not be contrary to the best public interest. Staff received no objection to the request. Speaking In Favor Of The Request James Pearson 2170 Summerset Beaumont, TX Speaking In Favor Of The Request None. Board Member Smith made a motion to approve the special exception for as recommended by the Planning Division staff. Motion seconded by Board Member Thompson. Motion carried 4:0.
