Jan has resided in the home located at 5575 Viking for the past 15 years. Necessary repairs must be made to the residence, in particular, the repair or replacement of the carport attached to the front of the house and a new roof. The original carport is supported only by a brick column in the center which has settled and moved over the years. The carport roof is sagging and could be a potentially dangerous situation. It is Jan's desire to enclose the area in order to give additional support to the roof and also for safety reasons so that she may enter her home through the garage area, especially if she returns to her home after dark. The lot upon which the home is situated is 67' across, and there is no room to attach a garage to either side. In order to enclose the carport area and make a new entry way, the architect's plan requires an additional 6.6 feet to extend beyond the building set back line for the addition. By enclosing the garage, the home will be safer and the improvement will visually enhance the neighborhood. Your consideration in granting a variance for the improvements will be greatly appreciated. Indicate how your application meets each of these conditions in the space following each condition. Separate sheets may be attached. (The applicant has the burden of proof to demonstrate that all three of the conditions necessary for a variance have been met). Except as otherwise prohibited, the Board is empowered to authorize a variance from a requirement of the Zoning Ordinance when the Board finds that all of the following conditions have been met: CONDITION A. That the granting of the variance will not be contrary to the public interest. The granting of the variance will not be contrary to the public interest in that it will not create a fire hazard or hinder traffic flow or do anything that would adversely affect the neighborhood. CONDMON B: That literal enforcement of the ordinance will result in unnecessary hardship because of exceptional narrowness, shallowness, shape:, topography or other extraordinary or exceptional physical situation or physical condition unique to the specific piece of property in 1 question. "Unnecessary hardship" shall mean physical hardship relating, to the property itself as distinguished from a hardship relating to convenience, financial considerations or caprice, and the hardship must not result from the applicant or owner's own actions. The literal enforcement of the ordinance will result in unnecessary hardship because the carport which is now attached to the front of the house is sagging and needs to be repaired or replaced. Applicant wishes to enclose the area for safety in driving into the garage and entering the home frem inside the ,garage area. In order to park two vehicles and make an entry from inside the garage area, Applicant can only move forward past the building setback line. The narrowness of the lot makes it impossible to add a ,garage onto either side of the property and the logical place to build it is where the carport is situated at this time. CONDITION Q That by granting the variance, the spirit of the ordinance will be observed and substantial justice will be done. By granting the variance, the spirit of the ordinance will be observed in that the addition will improve the appearance of the home and enhance the neighborhood and substantial justice will be done due to the improvement visually enhanceing the area and what was a potentially dangerous, unsightly carport will be transformed into a safe enclosed garage area.
