The Board of Adjustment has the power to grant variances where the following listed conditions have been met. Indicate how your application meets each of these conditions in the space following each condition. Separate sheets may be attached. (The applicant has the burden of proof to demonstrate that all three of the conditions necessary for a variance have been met). Except as otherwise prohibited, the Board is empowered to authorize a variance from a requirement of the Zoning Ordinance when the Board finds that all of the following conditions have been met: CONDITION A;- That the granting of the variance will not be contrary to the public interest. SEE ATTACHED "Exhibit A" CONDMON B: That literal enforcement of the ordinance will result in unnecessary hardship because of exceptional narrowness, shallowness, shape, topography or other extraordinary or exceptional physical situation or physical condition unique to the specific piece of property in question. "Unnecessary hardship" shall mean physical hardship relating to the property itself as distinguished from a hardship relating to convenience, financial considerations or caprice, and the hardship must not result from the applicant or owner's own actions. CONDMON Q That by granting the variance, the spirit of the ordinance will be observed and substantial justice will be done. I HEREBY ATTEST THAT, TO THE BEST OF MY KNOWLEDGE, MY REQUEST MEETS THE CONDITIONS STATED ABOVE. Applicant's signature: -Jl' Date: 10-16-92 »Exbi]zit A" ' \ Condition A^ ( / ^ This has been our homestead for over 20 years. The structure was here quite some time prior to that, with the preceding owners. Mever, have any of the improvements we, or our neighbors in immediate proximity, ever did or sought to do, ever impeded, infringed upon, or causad any manner of restriction Or harm to any of them or the general public, for that matter, It is our sincere belief that this small addiLion to an already longstanding structura (which will not extemd its outer boundary by a: inch) will in no way be contrary to the public interest,, Condition M The prEsemt dimension of our house is 24 feet by 55 feet. If we add an additional 14 feet to the rear of our house, it would take on the appearance of a giant trailer home. The preGent layout of the houso has no hallway separating roams. You are forced to wail from one roam through another to get to any racan. An addition to the rear would cause some of the space to be sacrificed for some sort of entrance or haLlway wheras if we built up~ almost all of the addition could be applied to living space. Also, as mentioned earlier in the reasons for my wife and I wanting to 6o this, to add to the rear would require the complete relocation or demolition and rebuilding of our existing carport. Condition C: The addition my wife and I are proposing only amounts to approximately twenty-five percent of the area of our existing house. We are not adding a full story to our home or even a half -story. This is, therefore, is no Way a significant breech of the city ordinance or its intent. - ^ "Exhibit B" proposed addition is to this area of existing, structure. Ui Iq-i Iz -4t.4'. (C01W 4-S + 'Exhibit C11 U-) NOTE: Above is a drawing of the proposed addition to be constructed nstructed over the rear fourteen feet of the existing structure.
