A meeting of the Board of Adjustment was held on February 3, 1994 with the following members present:
Chairman Jayne Eisen
Board Member Dohn LaBiche
Board Member Bob Harris
Board Member Chuck Mason
Board Members absent: Board Member Elray Wilson (excused), Board Member Bruce Irvine (excused),
Board Member William Lucas (unexcused), and Board Member Kevin Fuller
(excused).
Also present: Stephen C. Richardson, Planning Director; Murray Duren, Sr. Planner; Tyrone
Cooper, First Assistant City Attorney; Kim James, Planning Technician; and Jill
Manning, Recording Secretary.
APPROVAL OF MINUTES
Board Member LaBiche made a motion to approve the minutes of the December 2, 1993 Public
Hearing. Motion was seconded by Board Member Harris. Motion carried 4:0.

PUBLIC HEARING
1) File #364-BA: Consider an application for relief from Section 30-25 B.1.; allowed under Section 30-
37 (e) 2.b.(2), City Codes. A request for a special exception to allow the construction of a residence
on a corner lot with a 5 ft. exterior side yard building setback instead of the required 10 feet.
Location: 3340 Elinor at S. Eighth Street
Applicant: John Casmore for Evelyn Casmore
Chairman Eisen opened the public hearing.
Mr. Richardson explained that the subject property at 3340 Elinor was severely damaged by a fire in
December, 1993. It is the applicant's desire to rebuild the house for his mother. The original house
was built prior to the current setback requirements and therefore did not meet the new setback
regulations. The applicant wishes to rebuild the house, fronting on Elinor, with a side yard setback

of 5 feet on 8th Street and 5 feet on the interior side. The present setbacks of the house are 5 feet
on the corner exterior side, and 28 inches on the interior side. The applicant does not wish to build
a two-story house due to his mother's age. He would like to face the house on Elinor due to the fact
that all the houses on the street face Elinor.
Staff recommended approval of this request because they did not feel that it will create an adverse
impact on the neighborhood.
Twenty-eight notices were sent to property owners within 200 feet of the subject property. Ten
responses in favor and none in opposition have been returned.
Chairman Eisen asked if the applicant wanted to comment.
Mr. John Casmore, the applicant, addressed the Board. He told the Board that his mother's house
had been burned in a fire on Christmas Eve and asked for approval.
Chairman Eisen closed the public hearing.
Board Member LaBiche made a motion to approve the special exception as stated in File #364-BA.
Board Member Harris seconded the motion. Motion to approve carried 4:0.
THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED.
