HomeMy WebLinkAbout7-7-94 BA MinutesBOARD OF ADJUSTMENT July 7, 1994 City Council Chambers A meeting of the Board of Adjustment was held on July 7, 1994 with the following members present: Chairman Jayne Eisen Board Member Dohn LaBiche Board Member Bob Harris Board Member Elray Wilson Board Member Bruce Irvine Board Member William Lucas Board Member Kevin Fuller Board Member Chuck Mason Board Member Mary Jowers Also present: Stephen C. Richardson, Planning Director; Murray Duren, Sr. Planner; Bonnie Semien, Planning Technician; Jill Cole, Recording Secretary and Fred Lemell, Building Cade Official. APPROVAL OF MINUTES Board Member Fuller made a motion to approve the minutes of the May 5, 1994 Public Hearing. Motion was seconded by Board Member LaBiche. Motion carried 9:0. SWEARING IN OF WITNESSES PUBLIC HEARING 1) File #367-BA: Consider an application for a variance from the regulations of Section 30-25 (B) 1., City Codes, regarding the interior side yard building setback or yard requirements for a two-story structure in a residential district. A variance may be granted under Section 30-37 E.3. Location: 3440 Evalon Applicant: Paul Morrell Mr. Richardson explained that the request was for a variance from the required 7-1/2' building setback to 5 feet. The applicant received a building permit to construct a two-story BOARD OF ADJUSTMENT July 7, 1994 Public Hearing addition to the rear side of his one story residence. The permit was approved with a 5' setback. The Building Codes Division later realized that there was a problem with that and informed the property owner of the problem and required that he submit a request to the Board of Adjustment for approval. The addition is near completion. Staff felt that the application met the three requirements for granting a variance and recommended approval. Fifteen notices were sent to property owners within 200 feet of the subject property. Two responses in favor and none in opposition were returned. Chairman Eisen opened the public hearing and asked if the applicant wanted to comment. Mr. Paul Morrell, the applicant, addressed the Board. Jack Gearinger, 3410 Evalon, spoke in opposition and wanted to know when the permit was issued in relation to when construction was started. Board Member Fuller said that the staff report indicates that the building permit was issued November 8, 1993 and other permits were issued through May 25, 1994. Discussion followed between Board members and staff regarding issuance of permits, etc. Fred Lemell, Building Code Official, was present and addressed the Board. Chairman Eisen closed the public hearing. Board Member Harris made a motion to approve the variance as stated in File #367-BA. Board Member Fuller seconded the motion. Motion to approve carried 9:0. 2) File 368-BA: Consider the application for a variance from the regulations of Section 30-25 B. 1., City Codes regarding the exterior side yard building setback or yard requirements for a structure in a residential district. Location: 705 22nd Street Applicant: Thurman and Carolyn Crawford Mr. Richardson explained that the request is for a variance from the required 10' setback to 5'. The applicant received a building permit to demolish an existing carport and to construct the garage in place of the old carport. The permit was approved with a 5' setback. The Building Codes Division informed the property owner that there was a problem and has requested that he come before the Board. The garage is complete. It is staffs opinion that E BOARD OF ADJUSTMENT July 7, 1994 Public Hearing the application meets the three conditions necessary for granting a variance and therefore recommended approval. Twenty-one notices were sent to property owners within 200' of the subject property. Two responses in favor and none in opposition have been returned. Chairman Eisen opened the public hearing. The applicant, Mr. Bo Crawford, addressed the Board. His contractor, Mr. Castalina was also present. Glen Alegre, 630 22nd Street, addressed the Board in favor of the request. Chairman Eisen closed the public hearing. Board Member Wilson made a motion to approve the variance request as stated in File #368- BA. Board Member Jowers seconded the motion. Motion to approve carried 9:0. THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED. 3
