HomeMy WebLinkAbout9-1-94 BA MinutesBOARD OF ADJUSTMENT September 1, 1994 City Council Chambers A meeting of the Board of Adjustment was held on September 1, 1994 with the following members present: Board Member Dohn LaBiche Board Member Bob Harris Board Member Bruce Irvine Board Member Kevin Fuller Board Member Chuck Mason Board Member Mary Jowers Board Members Absent: Jayne Eisen (excused), Elray Wilson (excused) and William Lucas (excused). Also present: Stephen C. Richardson, Planning Director; Murray Duren, Sr. Planner; Bonnie Semien, Planning Technician; and Jill Cole, Recording Secretary. Due to Chairman Eisen's absence, Board Member Fuller was chosen to act as Chairman for the APPROVAL OF MINUTES Board Member Harris made a motion to approve the minutes of the July 7, 1994 Public Hearing. Motion was seconded by Board Member Mason. Motion carried 6:0. SWEARING IN OF WITNESSES PUBLIC HEARING 1) File #369-BA: Consider a request for a variance from the area and height regulations of Section 30-25 (b) 1. regarding the required interior side yard building setback for a proposed two-story addition to the rear of a residence; said variance may be allowed under Section 30- 37 (e) (3). Location: 3385 Westmoreland Avenue Applicant: Darrell W. Redeaux, Sr. BOARD OF ADJUSTMENT September 1, 1"4 Public Hearing Mr. Richardson explained that the request was for a variance from the side yard setback requirement of 7-1/2' to 5.4 feet. The applicant originally applied for and received a building permit for a one-story addition to the rear of his house. Later, he decided he wanted to add a second story to this addition. A second story requires that there be a side yard interior setback of 7-1/2 feet. Therefore, he stopped construction on his addition and applied for the variance. Staff recommended approval of the variance request because it felt that it meets the three conditions for approval of a variance. Twenty-five notices were sent to property owners within 200 feet of the subject property. There were no responses returned in favor or in opposition. In response to a question by Board Member LaBiche, Mr. Duren said the 7-1/2' requirement was adopted in the 1981 Zoning Ordinance. Board Member Fuller opened the public hearing and asked if the applicant wanted to comment. Darrell Redeaux, Sr., the applicant, addressed the Board. He told the Board he needed the addition for bedrooms for his children. Chairman Fuller asked for comments in favor or in opposition. There being none, the public heal_ Board Member LaBiche made a motion to approve the variance as stated in File #369-BA. Board Member Jowers seconded the motion. Motion to approve carried 5:0. (Acting Chairman Fuller abstained.) THERE BEING NO FURTHER BUSINESS, TIE MEETING WAS ADJOURNED. 2
