HomeMy WebLinkAbout8-5-99 BA MinutesBOARD OF ADJUSTMENT August S, 1999 City Council Chambers A meeting of the Board of Adjustment was held on August 5, 1999, with the following members present: Board Member Bob Harris Board Member Dohn LaBiche Board Member Lynn DeMary Alternate Member Lamar Roach Board Members absent: Board Member Alvin Cook Alternate Member Joe Ashy Alternate Member Mary Jowers Alternate Member Joe Ashy Alternate Member Georgine Guillory Also present: Stephen Richardson, Planning Director; Tyrone Cooper, First Assistant City Attorney; Bart Baker, Planner, and Nancy Nicholas, Recording Secretary. APPROVAL OF MINUTES Board Member LaBiche made a motion to approve the minutes of the July 1, 1999 Meeting. Board Member DeMary seconded the motion. Motion to approve carried 4:0. SWEARING IN OF WITNESSES PUBLIC HEARING 1) File 428-BA: A request for a special exception allowed under Sec. 30-37 from Sec. 30-28 requesting ten additional feet in height for an advertising sign. Location:3185 French Road, also known as 3625 Eastex Freeway Applicant: Maddison Dual Fuels, Inc, (MDF, Inc.) BOARD OF ADJUSTMENT August 5, 1999 Mr. Richardson stated that the applicant requested File 428-BA be withdrawn from the agenda in order to provide additional information. The case will be placed on the next Board of Adjustment meeting on September 2, 1999. 2) File 429-BA: A request for a variance to reduce the required 25' building setbacks abutting street rights -of -way for a proposed physical education, health, fine arts and assembly facility in a LI (Light Industrial) District. Location: Southwest corner of Fannin and Archie Streets Applicant: Father Jeremiah J. McGrath by Nicholas S. Baldo, Attorney -at -Law, for St. Anthony Cathedral School. Mr. Steve Richardson presented the staff report. He stated that the school plans to build a 10,000 plus square foot building to be used as a gym, fine arts and assembly facility. The school plans to have a circular drive serving the gymnasium. The gym and drive would be oriented toward Forsythe. Most of the buildings along Fannin appear to be built right up to the property line. Mr. Richardson added it was the applicant's burden of proof to demonstrate compliance with Conditions A, B and C. Seven notices were mailed to property owners within 200 feet. One response in favor and none in opposition were returned to staff, Slides of the subject property were shown. Board Member Harris, acting as Chairman, opened the public hearing -and asked for the applicant's comments. Mr. Steve Sill, Project Manager, stated that if the 25' setback is required along Archie and Fannin, the project will be encroaching on property that the church does not own. Therefore, the need for the variance. Site plans and drawings were presented to the Board for their perusal. Discussion followed between staff and the Board regarding placement of the setback, traffic patterns and the safety of children loading and unloading. Board Member Hams closed the public hearing. Discussion between the Board members followed. BOARD OF ADJUSTMENT August 5, 1999 Board Members LaBiche made a motion to approve a setback of 15' along Fannin Street and a setback of 10' along Archie Street for the proposed school building. The vote on the motion to approve File 429-BA follows: Board Member Harris - Yes Board Member LaBiche - Yes Board Member DeMary - Yes Alternate Member Roach - Yes The motion to approve carried 4:0. OTHER BUSINESS THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED.
