A meeting of the Board of Adjustment was held on December 2, 1999 at 3:00 p.m. with the
following members present:
Board Member Dohn LaBiche
Board Member Alvin Cook
Board Member Lynn DeMary
Board Member Mary Jowers
Alternate Member Ed Orr
Alternate Member Georgine Guillory
Board Members absent: Board Member Bob Harris
Alternate Member Lamar Roach
Alternate Member Joe Ashy
Also present: Stephen- Richardson, Planning Manager; Murray Duren, Senior
Planner; Lane Nichols, City Attorney; Adina Abshire, Planning
Technician; and Jill Cole, Recording Secretary
APPROVAL OF MINUTES
Alternate Member Orr made a motion to approve the minutes of the November 4, 1999
Public Hearing. Board Member Cook seconded the motion. Motion to approve carried
5:0.
SWEARING IN OF WITNESSES
PUBLIC HEARING
1) File 434-BA: A request for a variance to the maximum height regulations of Section 30-
28 (c) 3. to allow an owner identification pylon sign to exceed the 50' height limit in a
GC -MD (General Commercial -Multiple Family Dwelling) District. The request is for a
75' tall sign.
Location: 5875 Eastex Freeway
Applicant: Houser Neon Sign Company for IHOP Corporation

Mr. Richardson told the Board that an IHOP is being built at 5875 Eastex Freeway, in
front of K-Mart.
The applicant contends that a 50 foot tall sign would be blocked from view by two existing
billboards located northwest of their site. The applicant also claims that there are three
other 75 foot tall signs in the immediate vicinity.
The applicant has the burden of proof to show that conditions A, B and C have been met.
Four notices were mailed to property owners within 200 feet. No responses in favor or
in opposition were returned to staff.
Slides of the subject property were shown.
Board Member LaBiche opened the public hearing and asked for the applicant's comments.
Rick McDuff, Division Development Manager for IHOP Corporation, the applicant,
addressed the Board. Lee Smith from Houser Neon was also present.
(Board Member lowers arrived.)
Discussion between staff and Board members followed.
Board Member LaBiche asked for comments in favor or in opposition. No comments
were made. The public hearing was closed.
Alternate Member Guillory made a motion to approve the variance granting a height of
75 feet for an owner identification sign at 5875 Eastex Freeway as requested in File 434-
BA. Board Member Cook seconded the motion. The vote on the motion to approve File
434-BA follows:
Board Member LaBiche - Against
Board Member Jowers - For
Board Member Cook - For
Board Member DeMary - For
Alternate Member Guillory - For
The motion to approve File 434-BA carried 4:1.
OTHER BUSINESS
THERE BEING NO FURTHER BUSINESS THE MEETING WAS ADJOURNED AT 3:20.
