HomeMy WebLinkAbout5-4-00 BA Minutesi BOARD OF ADJUSTMENT May 4, 2000 City Council Chambers A meeting of the Board of Adjustment was held on May 4, 2000 at 3:00 p.m. with the following members present: Board Member Bob Harris Board Member Mary Jowers Board Member Lynn DeMary Alternate Member Ed Orr Board Members absent: Board Member Dohn LaBiche Board Member Alvin Cook Alternate Member Lamar Roach Alternate Member Joe Ashy Alternate Member Georgine' Guillory Also present: Stephen Richardson, Planning Manager; Murray Duren, Senior Planner; Tyrone Cooper, First Assistant City Attorney; Adina Abshire, Planning Technician and Jill Cole, Recording Secretary APPROVAL OF MINUTES Board Member DeMary made a motion to approve the minutes of the March 2, 2000 Meeting. Alternate Member Orr seconded the motion. Motion to approve carried 4:0. SWEARING IN OF WITNESSES PUBLIC HEARING 1) File 439-BA: A request for a variance to the 10' exterior side yard requirements of Chapter 30-25 B. 2. to allow a 5.4' side yard in a GC -MD (General Commercial -Multiple Family Dwelling) District. Location: Northwest corner of Tram Road and Old Voth Road Applicant: Darryl Landers BOARD OF ADJUSTMENT May 4, 2000 Mr. Richardson stated that the applicant wants to purchase the subject property and once the purchase is complete, he will build a new eight -bay carwash. The property is zoned GC -MD and was the site of a carwash many years ago; however, it has since been torn down and the entire tract is paved with concrete. The plumbing is still in existence where the old bays were, so the applicant wants to do rebuild a new structure over these bays for the car washing facility, plus some drying structures. And since the plumbing is already intact, he would like to reconstruct structures over where the old bays were - that would put one bay only 5.4' from the property line. If approved, the edge of the building would be 29.4' from the edge of the pavement of Tram Road. The applicant must demonstrate to the Board that the application meets all three conditions for the variance. Seven notices were mailed to property owners within 200 feet. No responses in favor or in opposition were returned to staff. Slides of the subject area were shown. In response to Board Member Harris, Mr. Richardson clarified the distance from the slab to the street. In response to Board Member DeMary, Mr. Richardson said that the applicant would not be required to put in a 6' wide landscaping strip. Discussion of road width followed. Board Member Harris opened the public hearing and asked for the applicant's comments. Darryl Landers, the applicant, addressed the Board. In response to Board Member DeMary, Mr. Landers said that a regular carwash bay is 16' wide and the one designated for handicapped persons will be 19' wide. Board Member Harris asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Discussion between the Board followed. In response to questions from the Board, Mr. Landers said that no part of the carwash bays would obstruct views of traffic on the street. Pa BOARD OF ADJUSTMENT May 4, 2000 Alternate Member Orr made a motion to approve an exterior side yard building setback of 5.4' for a commercial structure at the northwest corner of Tram Road and Old Voth Road as requested in File 439-BA. Board Member Jowers seconded the motion. The vote on the motion to approve File 439-BA follows: Board Member Harris - For Board Member Jowers - For Board Member DeMary - For Alternate Member Orr - For The motion to approve File 439-BA carried 4:0. OTHER BUSINESS THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED AT 3.28. 3
