Richardson, Planning Manager SUBJECT: Request for a variance to the front yard setback regulation for front yards in an RS (Residential Single Family Dwelling) District. I Mr. and Mrs. Ronald Broussard own and live in the single family home at 1075 Brandywine Drive in the Dowlen West Addition. They wish to build a new carport 28' x 21' 9-1/2" attached to and in front of a two car garage which is part of the house. The carport will extend out toward the front of the lot 28'. The lot is 120' deep and 88' wide. The survey exhibit shows a distance between the end of the carport and the property line of about 1-1/2 to2feet. The right-of-way of the street is 50' and the pavement is 27' wide, back of curb to back of curb. The front yard building setback in an RS District is 25' measured from the front property line. The applicant has the burden of proof to demonstrate that all three of the conditions necessary for a variance have been met. It's only purpose is to allow shaded area for a (6) year old child during the HOT summer months. CONDITION II: That literal enforcement of the ordinance will result in unnecessary hardship because of oxcwtioned numwritm, shaltovv=3, shape topography or other extraordinary or exceptional physical situation or physical wndition unique to the specific piece of property in question. "Unnecessary hardship" shall mean physical hardship relating to the property itself as distinguished from a hardship relating to convenience, financial considerations or caprice, and the hardship must not result from the applicant or owner's own actions, This driveway cover will be added so that it maintain's the same integrity of the existing house and house's in the neighborhood. It's appearance will add tremendous value and have the ability to allow my child to play outside this summer without harm due to the ultra violet rays from the sun.
