HomeMy WebLinkAbout6-1-00 BA MinutesBOARD OF ADJUSTMENT June 1, 2000 City Council Chambers A meeting of the Board of Adjustment was held on June 1, 2000 at 3:00 p.m. with the following members present: Board Member Bob Harris Board Member Lynn DeMary Alternate Member Lamar Roach Alternate Member Ed Orr Alternate Member Georgine Guillory Board Members absent: Board Member Dohn LaBiche Board Member Mary Jowers Board Member Alvin Cook Alternate Member Joe Ashy Also present: Stephen Richardson, Planning Manager; Murray Duren, Senior Planner; Tyrone Cooper, First Assistant City Attorney; Adina Abshire, Planning Technician and Jill Cole, Recording Secretary APPROVAL OF MINUTES Alternate Board Member Roach made a motion to approve the minutes of the May 4, 2000 Meeting. Alternate Member Orr seconded the motion. Motion to approve carried 4:0. SWEARING IN OF WITNESSES PUBLIC HEARING 1) File 440-BA: A request for a variance from the 25' front yard building setback regulations in an RS (Residential Single Family Dwelling) District. Location: 1075 Brandywine Applicant: Ronald "Bruce" Broussard BOARD OF ADJUSTMENT June 1, 2000 Mr. Richardson stated that Mr. and Mrs. Broussard want to build a new carport on the front of their house. The carport would be 28' x 21' 9-112". The carport will extend out toward the front of the lot 28' making the edge of the carport, at its closest, 1-112' from the property line. That would put the closest edge of the carport 13' from the back of the curb. The front building setback in an RS District is 25 feet. The applicant has the burden of proof to demonstrate that all three conditions necessary for a variance have been met. Twenty-seven notices were mailed to property owners within 200 feet. Four responses in opposition and none in .favor were returned. Slides of the subject area were shown. In response to Alternate Member Roach, Mr. Richardson said he did check City files, but was unable to locate deed restrictions for that neighborhood. Board Member Harris opened the public hearing and asked for comments in favor or in opposition. John Hogge, 6915 Blarney, addressed the Board in opposition to the request. Mr. Hogge read from the subdivision's deed restrictions that would prohibit Mr. Broussard from building the carport. (Board Member DeMary arrived.) Board Member Harris asked for the applicant's comments. Ronald Broussard, the applicant, addressed the Board and answered questions regarding his property and request. Board Member Harris asked for further comments in favor or in opposition. Gerald Christopher, 1030 Monterrey, spoke in opposition to the request. In response to Alternate Member Roach, Mr. Richardson read the responses that were received by staff. The public hearing was closed. 2 i BOARD OF ADJUSTMENT June 1, 2000 Discussion between the Board followed. Alternate Member Roach made a motion to deny a variance from the 25' front yard building setback regulations in an RS District at 1075 Brandywine as requested in File 440-BA, Alternate Member GuilIory seconded the motion. The vote on the motion to deny File 440-BA follows: Board Member Harris - For Board Member DeMary - For Alternate Member Roach - For Alternate Member Orr - For Alternate Member Guillory - For The motion to deny File 440-BA carried 5:0. OTHER BUSINESS THERE BEING NO FURTHER BUSINESS THE MEETING WAS ADJOURNED. 3
