HomeMy WebLinkAbout3-1-01 BA MinutesBOARD OF ADJUSTMENT March 1, 2001 City Council Chambers A meeting of the Board of Adjustment was held on March 1, 2001 at 3:00 p.m. with the following members present: Board Member Mary Jowers Alternate Member Lamar Roach Alternate Member Ed Orr Alternate Member Georgine Guillory Board Members absent: Board Member Bob Harris Board Member Dohn LaBiche Also present: Stephen Richardson, Planning Manager; Murray Duren, Senior Planner; Tyrone Cooper, First Assistant City Attorney; Adina Abshire, Planning Technician and Jill Cole, Recording Secretary APPROVAL OF MINUTES Alternate Member Roach made a motion to approve the minutes of the January 4, 2001 Public Hearing. Alternate Member Orr seconded the motion. Motion to approve carried 4:0. SWEARING IN OF WITNESSES PUBLIC HEARING 1) File 443-BA: A request for a variance to the regulations for an owner identification sign in an LI (Light Industrial) District for a height of 70' instead of the maximum allowed height of 50' . Location: 3985 College Street at IH-10 Applicant: Forbus Foods, Inc. (Waffle House) Mr. Richardson told ,the Board that the applicant, Forbus Foods, which operates the Waffle House at this address, has proposed a sign in front of the restaurant on the College side. BOARD OF ADJUSTMENT March 1, 2001 The restaurant previously had a sign on the freeway service road. The new owners of the Roadrunner Motel property require that the sign be removed at it's present location. The applicant contends that because of the new Cowboy Harley Davidson store, the sign at the required height or even at 60' in height would not be seen from the freeway when traveling east. The applicant shall have the burden of proof to demonstrate that all three conditions for a variance have been met. Seven notices were mailed to property owners within 200 feet. One response in opposition and none in favor were returned to staff. Slides of the subject property were shown. Board Member Jowers opened the public hearing and asked for the applicant's comments. Johnny Forbus, owner of the Waffle House, addressed the Board. He explained that unless he can construct his sign at 70', it will be impossible for cars traveling on I-10 to see the sign and exit in time. Board Member Jowers asked for comments in favor or in opposition. Charles Leyendecker, representative of the owners of the Roadrunner Motel and Cowboy Harley Davidson, addressed the Board. Mr. Leyendecker said he was unclear what the specifics of the request were and asked for clarification. Rebuttal by Johnny Forbus followed. Board Member Jowers closed the public hearing. Discussion between the Board members followed. Alternate Member Roach made a motion to deny a request for a variance to the regulations for an owner identification sign in an LI (Light Industrial) District for a height of 70' instead of the maximum allowed height of 50' at 3985 College as requested in File 443- BA. Board Member Orr seconded the motion.
