Pate, Jr., At -Large BECKY AMES, MAYOR Randy Feldschau, Mayor Pro Tern Taylor Neild, Ward I CITY COUNCIL MEETING Michael Getz, Ward II Audwin Samuel, Ward III NOVEMBER 3, 2020 Robin Mouton, Ward IV Tyrone Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on November 3, 2020, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentation and Recognition Public Comment: Persons may speak on the Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor Paul Vickery with Calvary Tabernacle Church gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tern Feldschau, Councilmembers Neild, Getz, Pate, Samuel (arrived at 1:38 p.m.) and Mouton. Absent: Kyle Hayes, City Manager and Tyrone Cooper, City Attorney. Also present were Sharae Reed; 1st Assistant City Attorney and Tina Broussard, City Clerk. Proclamations, Presentation, Recognitions None Public Comment: Persons may speak on the Consent Agenda None CONSENT AGENDA * Approval of minutes — October 27, 2020 Confirmation of board and commission member appointments — None Minutes — November 3, 2020 A. Authorize the City Manager to apply for and accept a Routine Airport Maintenance Program (RAMP) Grant from the Texas Department of Transportation (TxDOT) Aviation Division — Resolution 20-243 B. Authorize a one-year contract with the Downtown Beaumont Cultural Arts District (DBCAD) for FY 2021 - Resolution 20-244 C. Approve a resolution rejecting all bids received for the Lawson's Canal Reclamation Debris Hauling Contract - Resolution 20-245 D. Authorize the settlement of the claim of Akilia Bell - Resolution 20-246 Councilmember Neild moved to approve the Consent Agenda. Councilmember Mouton seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM FELDSCHAU, COUNCILMEMBERS NEILD, GETZ, PATE AND MOUTON NAYS: NONE MOTION PASSED PUBLIC HEARING Receive comments related to the City's Juvenile Curfew Ordinance Public Hearing Open: 1:34 p.m. None Public Hearing Close: 1: 34 p.m. Councilmember Samuel arrived at 1:38 p.m. GENERAL BUSINESS 1. Consider readopting the Juvenile Curfew Ordinance. Texas Local Government Code 370.002 requires that a home -rule municipality which has adopted a juvenile curfew ordinance periodically review the ordinance and its effect on the community and identify any problems with the ordinance or problems the ordinance was intended to remedy. The statute also provides for abolishing, continuing, or modifying the ordinance. In July 1994, following public review, the City Council adopted Ordinance No. 94-34 which created a new Chapter 9 establishing a curfew for minors. In 1995, Ordinance 95-37 was adopted which modified the curfew hours for minors. The ordinance has been reviewed and adopted as required, with the latest being in 2017, Ordinance 17-073. Minutes — November 3, 2020 The Curfew Ordinance has been extensively reviewed by the Police Department and determined to be effective in regard to promoting the safety and wellbeing of the city's youngest citizens. Renewal of this ordinance serves to promote the general welfare and protection of the public through the reduction of juvenile violence and crime within the city. Approval of the ordinance. Mayor Pro Tern Feldschau moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE REVIEWING AND READOPTING ARTICLE 12.03 OF THE CODE OF ORDINANCES ESTABLISHING A CURFEW FOR MINORS.; ESTABLISHING HOURS AND DEFINITIONS; PROVIDING A PENALTY CLAUSE; CITING SPECIFIC EXCEPTIONS AND DEFENSES; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. Councilmember Pate seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM FELDSCHAU, COUNCILMEMBERS NEILD, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Ordinance 20-062 WORK SESSION Review and discuss the City's Emergency Management Plan Shaqueena Nobles, Deputy Emergency Management Coordinator, reviewed and discussed the City's Emergency Management Plan. Ms. Nobles discussed the legal background for the Emergency Management Plan as well as the involvement of emergency management such as; major incidents, COVID-19 Pandemic, Hurricanes Laura, TS Beta and Hurricane Delta as well as several HAZMAT incidents on highways and continued recovery efforts from Hurricane Harvey along with other major events and exercise involvement. The focus for FY 2021 is the planning and continuity of operations and continued response to public health related disasters. The training and exercises are to support the planning focus, community wide planning teams, significant outreach programs that will encourage preparedness, cell phone registration and participation in state legislative advisory and emergency management committees. Within Emergency Management Planning lies recovery and mitigation which entails disasters that are currently in recovery phase such as Harvey, Imelda, Laura, Delta and COVID-19. The Hazard Mitigation Program is a five (5) year plan that's been updated and approved by FEMA in August 2017, just prior to Harvey. Major revisions/updates will be done in 2021 for re -approval in 2022. Grant support was also discussed as part of the Emergency Management Plan, the Emergency Management Performance Grant (EMPG) reimburses some program costs. The Port Security Grant Program (PSGP) provides the final step of our radio system upgrade to achieve full interoperability with neighboring HGAC regions and the State of Louisiana and supporting annual maintenance cost as well as the State Homeland Security Program and COVID-19 funding for equipment and payroll reimbursement. Minutes — November 3, 2020 PUBLIC HEARING Receive comments regarding the City's Emergency Management Plan Public Hearing Open: 1: 54 p.m. Addie Allen 9695 Gross Beaumont TX Stated that she didn't see anything in the plan that would alert citizens if there's an incident or something that's occurring, also thought it would be good to have an alarm system to alert citizens that there's something lurking, asked that Council take this into consideration to be included in the Management Plan Public Hearing Close: 2:00 p.m. COMMENTS Public Comments (Persons are limited to three minutes) Addie Allen 9695 Gross Beaumont TX Spoke with Council back in February and May regarding Municipal Airport, planes were flying all times of the day and night, since that time things have improved wanted to thank Council, mentioned the Grant that's going to be requested by the city for maintenance for the airport, asked that Council think about outreach to the community, especially in the Amelia area so that they can be given some voice and consideration, she does have some ideas that she would like to share with the Council, also addressed issues with weed abatement and the Code Enforcement Department * Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS COUNCILMEMBER GETZ - STATED THAT HE'S RECEIVED CALLS WITH CONCERNS REGARDING INTERSECTIONS THAT HAVE RIGHT ONLY TURNING LANES AND HOW DANGEROUS THEY CAN BE, ONE SPECIFIC CONCERN IS AT THE INTERSECTION OF DELAWARE AND DOWLEN, ASKED THE PUBLIC WORKS DEPARTMENT IF THERE COULD DEVICES PUT ON THE STREET THAT COULD HELP CITIZENS GET A VISUAL AS TO WHICH.DIRECTION A LANE IS TO GO, ANNOUNCED THAT THE BEAUMONT HOMELESS COALITION WILL MEET ON THURSDAY, NOVEMBER 5, 2020, AT 2:00 P.M., AT THE LAKESIDE CENTER, HAS RECEIVED OVER 40 RSVP'S THUS FAR, THANKED COUNCILMEMBERS PATE AND MOUTON FOR ATTENDING THE PRIOR MEETING AND LOOKS FORWARD TO SEEING THEM ON THURSDAY COUNCILMEMBER NEILD - ANNOUNCED THAT ON NOVEMBER 21, 2020, FROM 10:00 A.M. TO 4:00 P.M., THE BEAUMONT MUNICIPAL AIRPORT LOCATED AT 4155 KEITH RD., WILL HAVE A FLY IN, THERE WILL BE FOOD VENDORS ETC.., THIS WOULD BE A GOOD TIME TO BRING THE FAMILY OUT AND IT WILL BE KID FRIENDLY Minutes — November 3, 2020 MAYOR PRO TEM FELDSCHAU - STATED THAT HE WANTED TO BRAG ON BEAUMONT, AS EVERYONE KNOWS THERE HAS BEEN A CONCERN ABOUT VIOLENT PROTESTING AND RIOTING IN THE STREETS OF AMERICA, BUT HERE IN BEAUMONT THERE HAS BEEN PROTESTING, IT HAS BEEN PEACEFUL PROTESTING, STATED THAT HE ATTENDED SOME AND THEY WERE PEACEFUL AND PRODUCTIVE, RIGHT NOW THERE'S WARNINGS REGARDING POST -ELECTION VIOLENCE, CITIES ARE BOARDING UP THEIR BUSINESSES AND THE NATIONAL GUARD IS ON ALERT, APPRECIATES THAT THERE HASN'T BEEN ANY VIOLENT PROTEST IN BEAUMONT BECAUSE THAT'S NOT WHO WE AREAS A PEOPLE COUNCILMEMBER PATE - COMMENTED ON THE CONCERTAT FORD PARKAND THE WALL HONORING FIRST RESPONDERS, COMMENTED ON THE PASSING OF JORDAN BURTON AND BILLY TUBBS FORMER COACH AT LAMAR UNIVERSITY, MENTIONED THE REOPENING OF THE BABE ZAHARIAS MUSEUM, ENCOURAGED THOSE THAT HAVEN'T VOTED TO PLEASE DO SO AS THIS IS A RIGHT AND A PRIVILEGE COUNCILMEMBER SAMUEL - NONE COUNCILMEMBER MOUTON - GAVE CONDOLENCES TO THE FAMILY OF JORDAN BURTON, SHARED A STORY REGARDING A WOMEN BY THE NAME OF RUTH WHO'S 104 AND LIVES IN NEW YORK, SHE WAS VERY EXCITED TO VOTE, SHE CALLED HER GOING TO VOTE "RUTH TO THE BOOTH", MS.
