Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on October 13, 2020, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentation and Recognition Public Comment: Persons may speak on scheduled agenda items 1-3/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor Tommy Williams with Trinity United Methodist Church gave the invocation. MayorAmes led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were MayorAmes, Mayor Pro Tern Feldschau, Councilmembers Neild, Getz, Pate, Samuel and Mouton. Absent: Tyrone Cooper, City Attorney. Also present were Kyle Hayes, City Manager; Sharae Reed, 1st Assistant City Attorney; Tina Broussard, City Clerk. Proclamations, Presentation, Recognitions "White Cane Awareness Day" — October 15, 2020 - Proclamation read by Councilmember Mouton; accepted by Jeanetta Price, President of the National Federation of the Blind of Texas Golden Triangle Chapter "Emergency Nurses Week" — October 11-17, 2020 - Proclamation read by Councilmember Pate; accepted by Santana Olvera, President of the Golden Triangle Emergency Nurses Association "Lemonade Day" - October 18, 2020 - Proclamation read by Mayor Ames; accepted by Krista Hunter, Executive Director Beaumont Chamber Foundation Mayor Ames. read the announcement regarding Executive Session being held at the conclusion of the General Business portion of the meeting. Minutes — October 13, 2020 Public Comment: Persons may speak on scheduled agenda items 1-3/Consent Agenda None CONSENT AGENDA Approval of minutes — October 6, 2020 Confirmation of board and commission member appointments — None A) Authorize the City Manager to execute a lease agreement with the Beaumont Children's Museum — Resolution 20-214 B) Approve the purchase of two mowers and three utility tractors for use in various City Departments - Resolution 20-215 C) Approve a contract for the grounds maintenance of Martin Luther King, Jr. Parkway - Resolution 20-216 D) Approve the repairs to a compactor used at the Landfill - Resolution 20-217 E) Approve an annual maintenance agreement with SHI Government Solutions, Inc. for Microsoft Office 365 that is used by all city departments - Resolution 20-218 F) Authorize the City Manager to execute a Correction Special Warranty Deed to Stedman Ventures, Inc. - Resolution 20-219 G) Authorize the City Manager to execute an Interlocal Agreement with Jefferson County - Resolution 20-220 Councilmember Neild moved to approve the Consent Agenda. Councilmember Samuel seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM FELDSCHAU, COUNCILMEMBERS NEILD, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. Consider a resolution approving the purchase of two Vactor Combination Sewer Cleaners. One sewer cleaner in the amount of $394,916 will be purchased for use in the Streets & Drainage Division. This will replace unit 3348, a 2010 International 7400, which has exceeded the expected service life and will be disposed of in accordance with the City's surplus equipment policy. Minutes — October 13, 2020 One sewer cleaner in the amount of $394,916 will be purchased for use in the Sewer Maintenance Division. This will replace unit 3325, a 2006 International 7400, which has exceeded the expected service life and will be disposed of in accordance with the City's surplus equipment policy. Total pricing, in the amount of $789,832, was obtained from Freightliner of Austin, Texas, through the Buyboard contract. Buyboard is a cooperative purchasing association that complies with State of Texas' procurement statutes. Funds will come from the Capital Reserve Fund ($394,916) and the Water Utilities Fund ($394,916). Approval of the resolution. COuncilmember Neild moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL APPROVES THE PURCHASE OF TWO (2) VACTOR COMBINATION SEWER CLEANERS FOR USE BY THE VARIOUS CITY DEPARTMENTS FROM FREIGHTLINER, OF AUSTIN, TEXAS, IN THE AMOUNT OF $789,832.00 THROUGH THE BUYBOARD PURCHASING PROGRAM. Mayor Pro Tern Feldschau seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM FELDSCHAU, COUNCILMEMBERS NEILD, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Resolution 20-221 2. Consider a resolution approving the purchase of a new construction project management software solution from Systemates, Inc. The Public Works Department does not have a project management tool to manage ongoing construction projects. All of the corresponding data is maintained inside several spreadsheets and other document types. The software will allow users to efficiently track project timelines, accurately track costs, provide detailed and informative reports, as well as provide a central location for all users to upload and store documents. The cost is $117,404.00, which includes a one-time cost of $70,101.86 and a first -year subscription cost of $47,302.14. The second -year subscription cost is estimated at $49,067.13. Pricing was obtained through the State of Texas Department of Information (DIR). DIR provides cities and political subdivisions with the means to purchase information technology at volume prices contracted under the procurement statues of the State of Texas. Funds will come from the General Fund. The IT Department mistakenly requested $50,000 for this purchase in the budget process, which was for the projected subscription cost only. The Public Works Director believes this purchase is very important, and if approved, will look for cost savings in the $13.3 Million Public Works Budget for FY 2021 to offset the difference. Minutes — October 13, 2020 Mayor Pro Tern Feldschau moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY APPROVES THE PURCHASE OF PROJECTMATES CONSTRUCTION PROJECT MANAGEMENT SOFTWARE FOR USE BY THE PUBLIC WORKS DEPARTMENT FROM SYSTEMATES, INC., OF RICHARDSON, TEXAS, IN THE AMOUNT OF $117,404.00 THROUGH THE STATE OF TEXAS DEPARTMENT OF INFORMATION (DIR) CONTRACT. Councilmember Samuel seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM FELDSCHAU, COUNCILMEMBERS NEILD, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Resolution 20-222 3. Consider an ordinance accepting the 2020 Certified Tax Roll (FY 2021). The Jefferson Central Appraisal District submitted the Certified' Appraisal Roll on July 22, 2020, in the amount of $7,883,980,459. On September 22, 2020, the Council approved an ordinance to accept the appraised roll and established the property tax rate for the tax year 2020 (FY 2021). As required by Section 26.09 of the Tax Code: The tax assessor for a taxing unit shall calculate the tax imposed on each property included on the appraisal roll for the unit and send a Certified Tax Roll to the unit to be approved by Council. Approval of the ordinance. Councilmember Getz moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE ACCEPTING THE CERTIFIED TAX ROLL SUMMARY FOR THE TAX YEAR 2020 (FISCAL YEAR 2021); PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. AYES: MAYOR AMES, MAYOR PRO TEM FELDSCHAU, COUNCILMEMBERS NEILD, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Ordinance 20-058 COMMENTS None Public Comments (Persons are limited to three minutes) Councilmembers/City Manager/City Attorney comments on various matters Minutes — October 13, 2020 COUNCILMEMBER COMMENTS COUNCILMEMBER GETZ - STATED THAT HE RECEIVED SEVERAL CALLS FROM CONSTITUENTS AND NOT JUST FROM HIS WARD BUT OTHERS AS WELL, REGARDING DISCOLORED WATER, HAS COMMUNICATED THIS TO THE CITY MANAGER WHO HAS REQUESTED THAT HE MEET WITH MIKE HARRIS, HE PLANS ON DOINGS SO TO GET SOME ANSWERS COUNCILMEMBER NEILD - NONE MAYOR PRO TEM FELDSCHAU - STATED THAT AS EVERYONE KNOWS, THIS WEEK'JUDGE Amy CONEY - BARRETT IS BEFORE THE SENATE JUDICIARY COMMITTEE IN CONFIRMATION HEARINGS FOR THE SUPREME COURT, ENCOURAGED EVERYONE TO PARTICIPATE AND TO WATCH THE HEARINGS THAT ARE TAKING PLACE, THIS IS A DEMOCRATIC PROCESS THAT'S A PART OF OUR REPUBLIC, PLEASE UNDERSTAND HOW IMPORTANT APPOINTMENTS TO THE SUPREME COURT ARE, ASKED THAT EVERYONE PLEASE PRAY FOR THE SENATE COMMITTEE, JUDGE BARRETT AND THE ENTIRE PROCESS COUNCILMEMBER PATE - ENCOURAGED EVERYONE TO VOTE AS EARLY VOTING HAS STARTED ON TODAY, IMPORTANT THAT EVERYONE GET OUT AND VOTE, THANKED CITY EMPLOYEES AND ENTERGY ON A GREAT JOB THEY ARE DOING, COMMENTED ON THE PASSING OF ART HANSEN, GAVE CONDOLENCES TO HIS FAMILY, ALSO REMINDED EVERYONE THAT THIS IS BREAST CANCER AWARENESS MONTH AND AWARENESS FOR THE MEN AS WELL COUNCILMEMBER SAMUEL - ENCOURAGED EVERYONE TO GO OUT AND VOTE, EVERY VOTE MATTERS, EVERY VOTE COUNTS, STATED THAT HE RECEIVED A PHONE CALL FROM A CITIZEN THAT RODE HIS BICYCLE TO GO VOTE, THE CITIZEN WENT TO THREE DIFFERENT CITY FACILITIES AND ENCOUNTERED THE SAME PROBLEM, THERE WAS NO- WHERE FOR HIM TO PARK HIS BIKE, ASKED THAT THE CITY LOOK AT HAVING BICYCLE RACKS AT CITY FACILITIES TO FACILITATE THOSE INDIVIDUALS WHO RIDE BICYCLES, ALSO MENTIONED THAT INDIVIDUALS ARE GOING INTO CERTAIN NEIGHBORHOODS DUMPING LOADS OF TRASH WHICH IS ILLEGAL, WANTED TO INFORM INDIVIDUALS TO BE CAREFUL ABOUT WHO THEY APPROACH WHEN TRASH IS BEING DUMPED, IT COULD PRESENT A DANGER, ASKED THAT THEY FOLLOW PROPER PROTOCOL, 311 WOULD BE THE PLACE TO CALL, SUGGESTED THAT CITIZENS TAKE A PICTURE OF THE VEHICLE AS WELL AS THE LICENSE PLATE NUMBER, PLEASE DON'T APPROACH THOSE THAT ARE ILLEGALLY DUMPING, THANKED CITY STAFF FOR ALL THEY DO Minutes — October 13, 2020 COUNCILMEMBER MOUTON - STATED THAT TODAY IS THE FIRST DAY OF EARLY VOTING, ENCOURAGE EVERYONE EXERCISE THEIR RIGHT TO VOTE, ASKED THAT EVERYONE GET OUT AND PARTICIPATE IN THE WHITE CANE AWARENESS DAY WHICH WILL BE HELD ON OCTOBER 15, 2020 AT THE CORNER OF DRYDEN RD., AND TWIN CITY Hwy IN PORT ARTHUR, TX, CONGRATULATED OUR EMERGENCY NURSES AS THIS IS EMERGENCY NURSES WEEK, GAVE CONDOLENCES TO THE FAMILIES OF GABRIEL DURISO SR., BETTY LOU COLBERT BALL AND FANNIE MAE MOUTON, THANKED ENTERGY AND CITY EMPLOYEES FOR ALL THEY ARE DOING, WISHED HER GRANDSON JULIAN MOUTON JR., A HAPPY 10T" BIRTHDAY CITY ATTORNEY COOPER - ABSENT 1 ST ASSIST. CITY ATTORNEY REED- NONE CITY MANAGER HAYES - NONE MAYOR AMES - MADE COMMENTS REGARDING HURRICANE DELTA, THANKED THE EOC FOR A GREAT JOB THEY DO AS WELL AS THE SOLID WASTE DEPARTMENT, SPOKE REGARDING COVID-19, THE CITY IS STILL GETTING POSITIVE CASES AND SHE'S STILL SPEAKING WITH PHYSICIANS REGARDING HOW THE HOSPITALS ARE DOING, ALSO SPOKE REGARDING THE POWER OUTAGES AND THE PERCENTAGE OF POWER THAT HAS BEEN RESTORED AND THE PERCENTAGE OF POWER THAT HASN'T BEEN RESTORED, COMMENTED ON A WORKSESSION THAT WAS HELD ON LAST TUESDAY WITH THE COUNCIL, STATED THAT A BIG TOPIC OF CONVERSATION WAS DEALING WITH THE HOMELESS POPULATION, THERE WERE THREE COUNCILMEMBERS THAT VOLUNTEERED TO CONTINUE WITH A COMMITTEE THAT WAS FORMED THAT INCLUDED COUNCILMEMBERS PATEAND GETZ, COUNCILMEMBER MOUTON ALSO STATED SHE WOULD LIKE TO BE ON THE COMMITTEE, THE COMMITTEE WILL BE REINSTATED, IT WILL BE CALLED THE MAYORS TASK FORCE FOR THE HOMELESS Open session of meeting recessed at 2:27 p.m. EXECUTIVE SESSION Consider matters related to the deliberation of the purchase, exchange, lease or value of real property in accordance with Section 551.072 of the Government Code, to wit: Former Fire Station No. 1 located at 747 College Street Minutes — October 13, 2020 ere being no action taken in Executive Session, Council adjourned.
