Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on October 6, 2020, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: Invocation Pledge of Allegiance Roll Call * Presentation and Recognition Public Comment: Persons may speak on scheduled agenda items 1 & 2/Consent Agenda * Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor Andrew Wilson with Trinity Church gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tern Feldschau, Councilmembers Neild, Getz, Pate, Samuel and Mouton. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Beaumont TX Spoke to Council regarding Item E on the Consent Agenda; approving a one-year contract with the Beaumont Heritage Society/John Jay French Museum Ryan Smith 600 Main St. Beaumont TX Spoke to Council regarding Item C on the Consent Agenda; approving a one-year contract with the Texas Energy Museum CONSENT AGENDA Approval of minutes — Approval of minutes — September 29, 2020 Confirmation of board and commission member appointments - None A) Authorize compensation to the City Manager; City Attorney; City Clerk and Chief Magistrate for contribution to a retirement account or program — Resolution 20-202 B) Authorize a one-year contract with the Art Museum of Southeast Texas — Resolution 20-203 C) Authorize a one-year contract with the Texas Energy Museum — Resolution 20-204 D) Authorize a one-year contract with BUILD, Inc., Beaumont Main Street— Resolution 20-205 E) Authorize a one-year contract with the Beaumont Heritage Society/John Jay French Museum - Resolution 20-206 F) Authorize a one-year contract with the Southeast Texas Arts Council (SETAC) - Resolution 20-207 G) Approve the sale of City owned property (left of 2146 Pecan Street) - Resolution 20-208 H) Authorize the City Manager, or his designee, to execute all documents necessary, specifically a Memorandum of Understanding with the Garth House Mickey Mehaffy Children's Advocacy Program, Inc. - Resolution 20-209 1) Authorize the City Manager, or his designee, to execute an agreement with the DEA (Drug Enforcement Agency) - Resolution 20-210 J) Authorize the City Manager to enter into an Information Sharing Access Agreement with the Federal Emergency Management Agency (FEMA) - Resolution 20-211 Councilmember Neild moved to approve the Consent Agenda. Councilmember Mouton seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM FELDSCHAU, COUNCILMEMBERS NEILD, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE Minutes — October 6, 2020 MOTION PASSED GENERAL BUSINESS Consider authorizing the City Manager to execute an agreement with Beaumont Firefighters' Local 399. The proposed agreement is for a four-year period ending September 30, 2024. The salient changes from the existing contract related to pension contributions and wage increases. Currently, the City and the Employee contribute 15.5% of each employee's salary to the pension fund. The proposed agreement requires the City to gradually increase the contributions to 18% by October 2023. The Employee will gradually increase their contributions to 18% by October 2022. The agreement also provides for wage increases of 3% effective upon signing a new agreement; 3% in year two; 3% in year three and 4% in year four. The wage increase and increased pension contribution in 2020 (FY 2021) will have an estimated new cost of $700,000. Funds will come from the General Fund. Approval of a new agreement. Councilmember Mouton moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A COLLECTIVE BARGAINING AGREEMENT WITH THE BEAUMONT PROFESSIONAL FIREFIGHTERS' LOCAL 399 COMMENCING OCTOBER 1, 2020 AND EXPIRING SEPTEMBER 30, 2024. Councilmember Getz seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM FELDSCHAU, COUNCILMEMBERS NEILD, GETZ, PATE, SAMUEL AND MOUTON I i NAYS: NONE MOTION PASSED Resolution 20-212 2. Consider a resolution approving multiple contracts for the purchase of traffic marking materials. Bids were requested for annual contracts to supply signage, sign materials, hardware, specialty paints, traffic control materials and thermoplastic materials for use by various divisions within Public Works. Bids were requested from fourteen vendors and three submitted bid responses. Specifications were divided into eight sections and required that each section be awarded to the lowest qualified bidder who bid the entire section and complied with the required specifications. Approval of the resolution. COuncilmember Neild moved to APPROVE A RESOLUTION THAT THE BIDS SUBMITTED BY THE VENDORS FOR ANNUAL CONTRACTS FOR THE PURCHASE OF TRAFFIC MARKING MATERIALS FOR THE ESTIMATED TOTAL AMOUNT OF $649,261.85 BE ACCEPTED BY THE CITY OF BEAUMONT AND THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A CONTRACT WITH EACH OF THE VENDORS. Mayor Pro Tern Feldschau seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM FELDSCHAU, COUNCILMEMBERS NEILD, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Resolution 20-213 Mayor Ames read the announcement regarding Executive Session being held at the conclusion of the General Business portion of the meeting. COMMENTS Public Comments (Persons are limited to three minutes) Toni Prados 1090 Ave H. Beaumont TX Spoke to Council regarding the southern parts of town, stated that since Evelyn Lord was Mayor the citizens of that area have requested help with drainage, sewage etc., stated 1-10 to Waldon Road has been asked to be put on the City's agenda, all the roads out by the mall have never been streets before, the City has cut those roads and made beautiful streets out of them and they are still asking for help, asked what if the citizens from South Park, North End, Pear Orchid and some from the West End were to hold off payments on their property taxes until something is done in these communities, she has received a few calls from attorneys out of Houston who has stated to her it is doable and they are able to file discrimination against the City of Beaumont as their tax dollars aren't being used or utilized in Minutes — October 6, 2020 their community, knows that when they sue the city they will be suing themselves, asked what are they getting out of their tax dollars now? nothing but the rest of the city is getting things done in their communities on the backs of their tax dollars, wanted to know when will it stop, they have backed up sewage, flooding of their streets and more, also commented on the speeding on Sarah St., something needs to be done, there needs to be speed bumps and traffic control Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS COUNCILMEMBER MOUTON - STATED THAT THE COUNCIL ATTENDED A WORKSHOP PRIOR TO THE COUNCIL MEETING, WHICH HAD A LOT OF DETAILS OF WHICH MRS. PRADOS SPOKE ABOUT, ONE BEING A PROJECT FOR FLOODING WHICH COVERS THREE OF THE MAIN STREETS IN THE PEAR ORCHID WITH SARAH ST., BEING ONE, ALSO COMMENTED ON THE CONVERSATION SHE HAD WITH CHIEF SINGLETARY REGARDING PROBLEMS SARAH ST. AND WASHINGTON BLVD., HAS RECEIVED CALLS REGARDING SEWERISEWAGE PROBLEMS AND HAVE ADDRESSED THEM WITH STAFF, ALSO LOOKING FORWARD TO COMMUNITY POLICING THAT CAN ADDRESS SOME OF -THE ISSUES OF SPEEDING ETC., AGREES THERE NEEDS TO BE MORE POLICE PRESENCE IN THOSE AREAS, THANKED MRS. PRADOS FOR ATTENDING THE MEETING ON TODAY COUNCILMEMBER SAMUEL - NONE COUNCILMEMBER PATE - SPOKE WITH COUNCIL REGARDING HIS PROSTATE CANCER DIAGNOSES WHICH WAS AN AGGRESSIVE TYPE, STATED THAT HE HAS HAD PROSTATE SURGERY AND HAD HIS PROSTATE REMOVED AND THEY DID GET EVERYTHING, ENCOURAGED EVERYONE TO SEE THEIR DOCTOR REGULARLY AND TO GET REGULAR CHECKUPS ESPECIALLY WITH THIS BEING BREAST CANCER AWARENESS MONTH, THANKED EVERYONE IN HIS FAMILY FOR THEIR PRAYERS MAYOR PRO TEM FELDSCHAU - COMMENDED COUNCILMEMBER PATE FOR BEING TRANSPARENT AND SHARING HIS SITUATION WITH EVERYONE AND USING IT TO ENCOURAGE EVERYONE TO WATCH THEIR HEALTH, HIS PRAYERS WILL CONTINUE TO GO OUT TO HIM AS HE CONTINUES TO RECOVER COUNCILMEMBER NEILD - NONE COUNCILMEMBER GETZ - THANKED COUNCILMEMBER PATE FOR SHARING HIS EXPERIENCE WITH EVERYONE, STATED THAT HE WILL BE CALLING HIS PHYSICIAN, IT'S SOMETHING THAT A LOT OF PEOPLE MIGHT NOT THINK, ABOUT LIKE THEY SHOULD, WILL PRAY FOR HIM AS HE RECOVERS Minutes — October 6, 2020 CITY ATTORNEY COOPER - ' NONE CITY MANAGER HAYES - NONE MAYOR AMES - NONE Open session of meeting recessed at 2:11 p.m. EXECUTIVE SESSION Consider matters related to contemplated or pending litigation in accordance with Section 551.071 of the Government Code: Southern Choice Consulting, LLC v.
