Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on August 11, 2020, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: ;�7741-ki1 h Invocation Pledge of Allegiance Roll Call Presentation and Recognition Public Comment: Persons may speak on scheduled agenda items 1-3/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor Dwight Benoit with Magnolia Missionary Baptist Church gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tern Feldschau, Councilmembers Neild, Getz, Pate, Samuel and Mouton. Absent: Kyle Hayes, City Manager and Tyrone Cooper, City Attorney. Also present were Sharae Reed, 1 st Assistant City Attorney and Tina Broussard, City Clerk. Proclamations, Presentation, Recognitions None Public Comment: Persons may speak on scheduled agenda items 1-3/Consent Agenda None CONSENT AGENDA Approval of minutes — July 28, 2020 Confirmation of committee appointments — None A) Authorize the City Manager, or his designee, to execute a contract with TransUnion Risk and Alternative Data Solutions, Inc. — Resolution 20-160 Minutes — August 11, 2020 B) Authorize the Chief Financial Officer to execute all documents necessary to accept funding from The Texas Department of State Health Services related to COVID-19 — Resolution 20- 161 C) Authorize the City Manager to execute all documents necessary to apply for and accept grant funding from the Motor Vehicle Crimes Prevention Authority — Resolution 20-162 D) Authorize the acceptance of a ten -foot -wide Exclusive Water Line Easement for the construction of new apartments located at 6120 Folsom Drive — Resolution 20-163 E) Authorize the acceptance of a ten -foot -wide Exclusive Water Line Easement for the construction of new apartments located at 5740 Northwest Parkway — Resolution 20-164 F) Authorize the acceptance of a ten -foot -wide Exclusive Water Line Easement for the construction of new apartments located at 4208 North Major Dr. — Resolution 20-165 Councilmember Neild moved to approve the Consent Agenda. Councilmember Pate seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM FELDSCHAU, COUNCILMEMBERS NEILD, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. Consider a resolution receiving the proposed FY 2021 Budget and scheduling a public hearing. Article VI, Section 2 of the City Charter requires that the proposed budget be submitted to the Council at least 45 days prior to the beginning of the new fiscal year. In addition, Section 4 requires Council to schedule a public hearing on the proposed budget. The Administration recommends that a public hearing be held on September 15, 2020, at 1:30 p.m. in Council Chambers, located at 801 Main Street. The City Clerk will publish the notice of the public hearing. Councilmember Getz moved to APPROVE A RESOLUTION THAT THE PROPOSED FY 2021 BUDGET HAS BEEN RECEIVED AND A PUBLIC HEARING IS HEREBY SCHEDULED FOR SEPTEMBER 15, 2020 AT 1:30 P.M. IN THE CITY COUNCIL CHAMBERS, CITY HALL, 801 MAIN STREET, BEAUMONT, TEXAS, AND THAT THE CITY CLERK IS TO PUBLISH NOTICE OF SAID HEARING PURSUANT TO THE CHARTER OF THE CITY OF BEAUMONT. AYES: MAYOR AMES, MAYOR PRO TEM FELDSCHAU, COUNCILMEMBERS NEILD, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Minutes —August 11, 2020 Resolution 20-166 2. Consider a resolution receiving the proposed 2021 Capital Program and scheduling a public hearing. The proposed 2021 Capital Program was originally submitted to Council on May 15, 2020. The proposed Capital Program is attached for your review with a few changes that are highlighted. Article VI, Section 20 of the City Charter requires Council to schedule a public hearing on the proposed Capital Program. The Administration recommends that a public hearing be held on September 15, 2020, at 1:30 p.m. in Council Chambers, located at 801 Main Street. The City Clerk will publish the notice of the public hearing. Councilmember Pate moved to APPROVE A RESOLUTION THAT THE PROPOSED FY 2021 CAPITAL PROGRAM HAS BEEN RECEIVED AND A PUBLIC HEARING IS HEREBY SCHEDULED FOR SEPTEMBER 15, 2020 AT 1:30 P.M., IN THE CITY COUNCIL CHAMBERS, CITY HALL, 801 MAIN STREET, BEAUMONT, TEXAS, AND THAT THE CITY CLERK IS TO PUBLISH NOTICE OF SAID PUBLIC HEARING PURSUANT TO THE CHARTER OF THE CITY OF BEAUMONT. Councilmember Getz seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM FELDSCHAU, COUNCILMEMBERS NEILD, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Resolution 20-167 3. ' Consider establishing and taking a record vote on the proposed 2020 tax rate and schedule a public hearing. Chapter 26 of the Property Tax Code requires taxing units to comply with truth -in -taxation laws in adopting their tax rate and requires the governing body to hold a public hearing when the proposed tax rate exceeds the lower of the no -new revenue or voter -approval tax rate. Administration recommends Council establish a tax rate required to support the City Manager's proposed budget equal to the tax rate of $0.71/$100 of valuation. In accordance with Chapter 26 of the Property Tax Code, if the proposed rate exceeds the no -new revenue rate of $0.690967/$100 or the voter -approval tax rate of $0.734257/$100, the City Council must take a record vote to place the proposal to adopt the rate on the agenda of a future meeting. The no -new revenue tax rate is the rate that would produce the same amount of taxes in FY 2021 as was produced in FY 2020 if it was applied to the same properties taxed in both years. The proposed tax rate of $0.710000/$100 exceeds the no -new revenue tax rate of $0.690967/$100 by $0.019033/$100 or 2.7%. If the motion passes, a public hearing must be scheduled. It is recommended that the public hearing be held on September 15, 2020 at 1:30 p.m. in the Council Chambers. Minutes —August 11, 2020 Mayor Pro Tern Feldschau moved to APPROVE A RESOLUTION WITH REVISIONS THAT THE 2020 TAX RATE IS PROPOSED TO BE $0.7111$100 OF VALUATION; AND THAT THE DATE OF SEPTEMBER 15, 2020 BE AND THE SAME IS HEREBY SET AS THE DATE AT WHICH THE CITY COUNCIL WILL CONDUCT PUBLIC HEARINGS ON THE PROPOSED TAX RATE. THE MEETING WILL BE HELD IN THE CITY COUNCIL CHAMBERS, CITY HALL, 801 MAIN STREET, BEAUMONT, TEXAS AT 1:30 P.M., SEPTEMBER 15, 2020, AT WHICH TIME THE COUNCIL WILL RECEIVE PUBLIC COMMENT ON THE PROPOSED TAX RATE OF $0.71/$100 OF VALUATION AND THAT THE CITY CLERK IS TO PUBLISH NOTICE OF SAID PUBLIC HEARING PURSUANT TO V.T.C.A., TAX CODE §26.06. RECORD VOTE: MAYOR AMES MAYOR PRO TEM FELDSCHAU COUNCILMEMBER NEILD COUNCILMEMBER GETZ MOTION PASSED Resolution 20-168 COMMENTS YES COUNCILMEMBER PATE YES COUNCILMEMBER SAMUEL YES COUNCILMEMBER MOUTON YES Public Comments (Persons are limited to three minutes) Miles Edward Thomas 4165 Chaison St. YES YES YES Beaumont TX Asked how he could apply to run for City Council, District Attorney etc., commented on the high school that he attended as well as schools opening for BISD, also commented on mask that have to be worn and the Corona Virus Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS COUNCILMEMBER NEILD - NONE COUNCILMEMBER GETZ - NONE MAYOR PRO TEM FELDSCHAU - GAVE CONDOLENCES TO THE FAMILY OF OFFICER SHEENA YARBROUGH-POWELL AND TO THE ENTIRE BEAUMONT POLICE DEPARTMENT, ALSO WISHED OFFICER GABRIEL FELLS A SPEEDY RECOVERY, COMMENTED ON THE CORONA VIRUS AND WHERE WE ARE AS A CITY, ENCOURAGED EVERYONE TO NOT ONLY PRACTICE SAFE DISTANCING BUT LET ALL OF US BE SAFE AND RESPONSIBLE WHEN IT COMES TO ALCOHOL CONSUMPTION AND HOW WE MEDICATE OURSELVES TO GET THROUGH THIS PANDEMIC, EVERYONE HAS TO BE CAREFUL HOW WE HANDLE THIS MOMENT THAT WE ARE IN, STATED THAT HE UNDERSTANDS THAT IT'S STRESSFUL, PEOPLE ARE TIRED, BUT EVERYONE CAN AGREE THAT THEY HAVE TO BE CAREFUL, Minutes —August 11, 2020 BE SAFE AND RESPONSIBLE IN THE MANNER IN WHICH WE ARE ATTEMPTING TO NAVIGATE THROUGH THIS VERY CHALLENGING TIME, ENCOURAGED EVERYONE TO PLEASE STAY SAFE COUNCILMEMBER PATE - APPRECIATED ALL OF THE CLERGY BEING PRESENT AT THE MEETING ON TODAY, GAVE CONDOLENCES TO THE FAMILIES OF OFFICER SHEENA YARBROUGH-POWELL, EVELYN MANNING AND DAVID WHITE, WISHED OFFICER GABRIEL FELLS A SPEEDY RECOVERY, ANNOUNCED THAT WOMEN'S PROFESSIONAL GOLF WOULD BE COMING BACKED TO BEAUMONT IN SEPTEMBER COUNCILMEMBER SAMUEL - GAVE CONDOLENCES TO THE FAMILY OF OFFICER SHEENA YARBROUGH-POWELL AS WELL AS THE ENTIRE BEAUMONT POLICE DEPARTMENT COUNCILMEMBER MOUTON - GAVE CONDOLENCES TO THE FAMILIES OF OFFICER SHEENA YARBROUGH-POWELL, AS WELL AS THE HENRY, PREJEAN, HUNT, BROUSSARD AND TURNER FAMILIES, WISHED OFFICER GABRIEL FELLS A SPEEDY RECOVERY, THANKED THE CLERGY FOR BEING PRESENT AT THE MEETING, ALSO THANKED BENGY WILLIAMS AND THE SOLID WASTE DEPARTMENT FOR THE QUICK CLEANUP OF TREES AND DEBRIS THAT BLOCKED. ROADS ETC., AFTER THE BRIEF WEATHER CONDITIONS THAT OCCURRED ON LAST WEEK CITY ATTORNEY COOPER - NONE CITY MANAGER HAYES - NONE MAYOR AMES - THANKED THE CLERGY FOR BEING PRESENT AT THE MEETING ON TODAY, GAVE CONDOLENCES TO THE FAMILY OF OFFICER SHEENA YARBROUGH-POWELL AS WELL AS THE FAMILY OF CORRECTIONS OFFICER DUDLEY CHAMP, WHO WORKED WITH THE JEFFERSON COUNTY SHERIFF'S OFFICE, HE DIED FROM COMPLICATIONS OF COVID-19, WISHED A SPEEDY RECOVERY FOR OFFICER GABRIEL FELLS, COMMENTED ON THE VISIT BY GOVERNOR GREG ABBOTT TO THE CITY OF BEAUMONT ON TODAY, ASKED IF ANYONE TESTED POSITIVE FOR THE VIRUS TO PLEASE VISIT THE BLOOD BANK TO DONATE THEIR PLASMA TO TREAT PATIENTS WITH COVID there being l Executive Session, Council adjourn Tina Broussard: Citv Clerk d� r� wi e .m.
