Richardson, Planning Manager SUBJECT: Request for variances to the minimum side yard setback from 7 2' to 2 2' and to the minimum rear yard setback from 15' to 11' FILE: 539-BA STAFF REPORT David Bourquein, the applicant, is requesting variances to side yard and rear yard setbacks for the property at 4845 Littlewood. Mr. Bourquein is wishing to add a second story to an existing garage and connect the garage to the house with an elevated enclosed walkway. The second story of the garage will consist of two bedrooms and a television room. The original garage was built to within 2 2' of the side yard setback and to within 11' of the rear yard setback. Now that a second story is being added to the garage and the entire structure is being connected to the house, a 7 2' side yard setback and a 15' rear yard setback are required. Mr. Borquein states that moving or demolishing and rebuilding the entire garage would be cost prohibitive. Mr. Borquein also looked at cutting off the living space that infringes on the side yard setback and determined that the structure would not look appealing to the neighbors and from the street. He states that windows will not be included on the rear of the structure. The applicant shall have the burden of proof to demonstrate that all three conditions necessary for approval of a variance have been met. Exhibits are attached.
