FILE: 563-BA STAFF REPORT Lee Guseman has applied for a variance to the minimum rear yard setback from 15' to 5'. The property is located at 5980 Rankin. Mr. Guseman states that the existing house on the property is being demolished down to the soil. Walter and Melissa Voigtman have purchased the subject property because of its location and the existing trees on the property. Mr. Guseman says that the existing house was built at the 15' rear setback line. The Zoning Ordinance normally requires a 25' setback line. However, it may be reduced to 15' if no accessory buildings are constructed within the reduced rear yard. Mr. Guseman states that requiring the house to be built at the 15' rear setback would require the removal of several oak trees. As proposed, the north end of the garage would be 5' off the north property line. The applicant shall have the burden of proof to demonstrate that all three conditions necessary for approval have been met. Exhibits are attached.
