Richardson, Planning Manager SUBJECT: Consider a request for variances to the minimum side yard building setback from 5' to 1' and to the minimum rear yard building setback from 10' to 1' 4" FILE: 580-BA STAFF REPORT Kenneth Jenkins has applied for variances to the minimum side yard building setback from 5' to 1' and to the minimum rear yard building setback from 10' to 1' 4". The property is located at 1527 Laurel. Mr. Jenkins states that Hurricane Ike destroyed a large portion of the building, roof and upper portions of the building walls. Since the reconstructed building would need to meet wind codes, he demolished what was left of the existing building. He decided that a totally new building built on the existing slab would look nicer and be more cost effective. Mr. Jenkins states that the building was built prior to the current Zoning Ordinance. To meet the current zoning requirements would require that parts of the existing slab be demolished and it be moved almost 9' to the north He feels that such a requirement would cause undue hardship, considering the circumstances. The applicant shall have the burden of proof to demonstrate that all three conditions necessary for approval have been met. Exhibits are attached.
