SUBJECT: Consider a request for a variance to the front yard building
setback from 25' to 19.1' for a cover over a wheel chair ramp
on the front of a single family residence

STAFF REPORT
Harry Vine has applied for a variance to the front yard building
setback from 25' to 19' for a cover over a wheel chair ramp on the
front of a single family residence. The property is located at 4005
Chaison.
Mr. Vine states that FNT Construction Services was hired by Michael
Newman to construct a wheelchair ramp for his wife. Mr. Newman
asked FNT Construction to construct a roof over the ramp area so
that use of the ramp during inclement weather could be performed
safely and comfortably.
In order to cover the ramp, an encroachment of 5'11" into the 25'
setback is required. Mr. Vine states that because of the layout of the
existing carport and house, this is the only ramp configuration that
will meet ADA requirements.
The applicant shall have the burden of proof to demonstrate that all
three conditions necessary for approval have been met.
