Richardson, Planning Manager SUBJECT: Consider a request for a variance to the rear yard building setback from 15' to 5' FILE: 592-BA STAFF REPORT Bill Clark Pest Control has applied for a variance to the rear yard building setback from 15' to 5'. The property is located at 2975 N. Eleventh Street. Mr. Clark would like to construct a parking shed to park company vehicles under. Mr. Clark states that to meet the required setbacks, he would have to build the parking shed so far from the property line that the shed would destroy the use of the existing parking lot. Mr. Clark states that due to growth of the company, they have recently undertaken an infrastructure renovation to accommodate the company=s growth needs. The parking lot renovations have been completed. The company would now like to construct the parking shed. However, once the contractor tried to permit the parking shed, it was realized that if the shed was constructed at the required setbacks, it would be difficult to construct the parking shed as planned. Mr. Clark states that because of the shape of his lot, he would not be able to build the parking shed on the subject property. He needs the shed because several company vehicles are laden with weather sensitive equipment and they must be parked under covered parking. The applicant shall have the burden of proof to demonstrate that all three conditions necessary for approval have been met. Exhibits are attached.
