Richardson, Planning Manager SUBJECT: Request for variances to the minimum side yard building setback requirement from 20' to 10.2'. FILE: 590-BA STAFF REPORT Charlee Hanna-Rule, the applicant, is requesting a variance to the maximum side yard building requirement from 20' to 10.2' for a two-story 2,300 square foot building to be used as a dance studio at 4305 Calder Avenue. The property is located adjacent to R-S (Residential Single-Family Dwelling) district. Parking on the property is at a premium and in an attempt to preserve all of the existing parking spaces, the building will need to be set at this location. An existing building located on the property is located 10' from the side property line. Additional parking will be provided on other property owned by Ms. Hanna-Rule that is located across Calder and Lucas. The Zoning Ordinance allows required parking to be located within 400 feet of the subject property. The applicant shall have the burden of proof to demonstrate that all three conditions necessary for approval of a variance have been met. Exhibits are attached.
