Richardson, Planning Manager SUBJECT: Consider a request for a variance to the minimum setback for a detached owner identification sign from 10' to 1' FILE: 636-BA STAFF REPORT This item was considered by the Board of Adjustment on November rd 3. At that meeting, a motion to approve failed by a vote of 3:2:1. Alternate Member Kelli Maness abstained thinking she had a conflict of interest. After the meeting, Ms. Maness discussed the alleged conflict of interest with the City Attorney. It was determined that she did not have a conflict of interest and if she voted, the outcome on th 636-BA would have been different. On November 14, the Board of Adjustment considered whether to allow a rehearing on 636-BA. On that date, the Board of Adjustment voted to allow 636-BA to be reheard. Kehil (Kevin) Akhani, representing Beaumont Chevron, has applied for a variance to the minimum setback for a detached owner identification sign from 10' to 1'. The property is located at 1050 IH-10 South. Mr. Akhani states that the existing high rise sign is not visible to traffic along College St. and IH-10 due to the canopy blocking the sign. Mr. Akhani contends that due to lot size, he doesn=t have enough space to put a sign that will meet the 10' setback and still be seen from the adjacent streets. The applicant shall have the burden of proof to demonstrate that all three conditions necessary for approval have been met. Exhibits are attached.
