Richardson, Planning Manager SUBJECT: Consider a request for a variance to the minimum front yard building setback from 25' to 0' FILE: 628-BA STAFF REPORT Mike Albanese has applied for a variance to the minimum front yard building setback from 25' to 0' for a parking lot at 2320 Broadway. In May, 2008, the owner of the former Easy=s Restaurant received a specific use permit to allow a parking lot on the subject property. However, that person built the parking lot without a building permit. The parking lot was constructed without meeting any of the conditions of the specific use permit. One of those conditions was that it must meet a 25' building setback along Broadway. The Historic District regulations state that A a parking lot must be setback along street frontages not less than the required setbacks or as far back as the front of the immediately adjacent buildings, whichever is greater.@ In June, 2011, the applicant received a specific use permit to allow a parking lot on the property to the east of the subject property. During that same month, the Board of Adjustment granted Mr. th Albanese a variance to the 25' building setback along 7 St. and Broadway. The applicant shall have the burden of proof to demonstrate that all three conditions necessary for approval have been met. Exhibits are attached.
