STAFF REPORT
Bill Unger with Premier Pools and Spas has applied for a variance to
the minimum setback for a paved hard surface from 2' to 1'. The
property is located at 7910 Silverleaf.
Premier Pools and Spas has constructed a swimming pool with an
attached slide. The slide is built into a raised rock base of which the
edge of the rock is 1' from the property line. A minimum of 2' from
any property line is required for any paved hard surface. Mr. Unger
states that he has spoken to the neighbors and they have no
reservations about the closeness of the rock feature.
The site plan submitted with the building permit shows the edge of the
slide being 3' from the rear property. A building inspector states
that the edge of the rock itself is only one foot from the property line.
The applicant shall have the burden of proof to demonstrate that all
three conditions necessary for approval have been met.
