Eliot New Commissioner Carol Fernandez Commissioner Thomas Sigee Commissioner Reagan Rothenberger Commission Members absent : Commissioner Marty Craig Commissioner Jason Cansler Commissioner Jessie Davis Councilmembers present: Councilmember Virginia Jordan Councilmembers absent: Councilmember-at-Large Gethrel Williams-Wright Councilmember Mike Getz Also present: Chris Boone, Director of Planning and Community Development Adina Josey, Senior Planner Raymond Rowzee, Planner I Anna Varela, Historic District Code Enforcement Officer Fran Malvo, Recording Secretary APPROVAL OF MINUTES Commissioner Linsley made a motion to approve the minutes of the Regular Meeting held on June 12, 2017. Commissioner Sigee seconded the motion. Motion to approve carried 8:0. REGULAR MEETING 1) CA-2792: Request for a Certificate of Appropriateness for a chain link fence along the side property line. Applicant: Lorenzo Barajas Historic Landmark Commission July 10, 2017 Location: 2475 North Street Mrs. Josey presented the staff report. Lorenzo Barajas has constructed a chain link fence along his west property line at 2475 North Street. An application for a Certificate of Appropriateness was submitted after Code Enforcement discovered the violation. Mr. Barajas has stated that the fence is needed for security purposes. The neighboring apartment tenants drive their vehicles onto his property, and walk across his rear yard. As the fence does not enclose any part of the yard, it is staff’s opinion that a wooden privacy or picket fence would serve the same purpose as the new chain link fence. The property is not listed in SPARE. Planning staff recommended denial of the request. Slides of the subject property were shown. Mr. Barajas, 2475 North Street, addressed the Commission. Mr. Barajas’ brother addressed the Commission and explained why he installed the fence. Chairman Blazek stated that the fence needed to be a wooden fence and not a chain link fence. Commissioner New suggested to Mr. Barajas that he could still use the chain link fence for his backyard but not the front yard. Discussion followed. Commissioner LaBiche stated to Mr. Barajas that he cannot modify the home in any way without first obtaining permission from the City of Beaumont. Commissioner LaBiche made a motion to deny the request for a Certificate of Appropriateness for a chain link fence in a side yard as requested by File CA-2792. Commissioner Fernandez seconded the motion. Motion to deny carried 8:0.Chairman Blazek stated to Mr. Barajas that his request for his chain link was denied, however, a wooden privacy fence can be installed along the side of the yard. 2) CA-2795: Request for a Certificate of Appropriateness for a new 6 unit apartment building. Applicant: Tom Cockerill Location: 2260 Harrison Avenue Mrs. Josey presented the staff report. Tom Cockerill was approved for a Certificate of Appropriateness to allow the construction of a new apartment building in October of last year. The property is located at 2260 Harrison Avenue. Mr. Cockerill's Certificate of Appropriateness expired during the permitting process and must be reconsidered for approval. In September 2016, the Historic Landmark Commission tabled this project to allow Mr. Cockerill time to redesign the look of the project to better fit into the neighborhood. Brick was added to the first floor exterior for the elevation facing the street. A porch with columns and shutters were also added. Additional windows for the rear and left elevations were added in the October meeting. 2 Historic Landmark Commission July 10, 2017 The new structure will consist of six (6) units. Four (4) units will have two (2) bedrooms, and two (2) units will have one (1) bedroom. The construction methods employed would dictate that the house be constructed on a slab foundation, wood framing, horizontal lap cement fiber siding and 30 year architectural roofing shingles. Windows will have white vinyl frames, and will be of a four over four appearance. The roof will have a 6/12 pitch and a front gable. Mr. Cockerill has chosen a black 30 year, architectural shingle for the roof. The paint is to be SW2827 Colonial Revival with SW2829 Classic White trim and SW2802 Rookwood Red & SW6258 Tricon Black accents. This color scheme was chosen from the approved pallet. Planning staff recommended approval of the request, subject to the following conditions: 1. Storm shutters must be located on all windows and must be architecturally appropriate. 2. Front and rear setbacks must be a minimum of 25 feet. 3. All windows must be six (6) light over one (1) light. 4. A building permit must be obtained and approved. All zoning and building code requirements must be met. 5. Appearance must match elevations approved on October 13, 2016 with exceptions to conditions 1 & 3. Slides of the subject property were shown. Chairman Blazek asked if Mr. Cockerill needed to have the CA approved before obtaining The permits. Mrs. Josey stated yes. Mrs. Josey also stated that Mr. Cockerill is permitted to have the apartment units in the neighborhood per Planning and Zoning guidelines. Mr. Cockerill did not submit revised plans to the Commission. Mrs. Josey clarified that the revised plans required all windows to be six light over one light and that all new conditions had been added to the requirements. Commissioner New expressed concerns regarding the parking and wanted to enforce that parking on the grass is prohibited. Mrs. Josey also stated that as per City ordinance, parking and landscaping are required and there are 1 ½ parking spaces per unit. No additional landscaping is required. Discussion followed. Chairman Blazek asked if the geographical area was High Density or Medium Density. Mrs. Josey replied Medium Density. Mr. Boone addressed the Commission to clarify the vested rights Mr. Cockerill is entitled to regarding zoning issues. Mr. Boone stated that because Mr. Cockerill started the process before the zoning was changed; he is entitled to vested rights. Mr. Boone also suggested to the Commission that he can check with the Traffic Engineer if there are any on street parking issues. No further discussion. Commissioner LaBiche made a motion to approve a request for a Certificate of Appropriateness to construct a new six (6) unit apartment building as requested for File CA-2795 with the following conditions: 1. Motion to approve carried 7:1 (Blazek). 3) Historic District Code Enforcement Report Mrs. Varela addressed the Commission and presented the Code Enforcement report. Discussion followed. OTHER BUSINESS Pickens Historic Loan Mrs. Josey addressed the Commission. Chairman Blazek recapped the issue regarding the Pickens loan. Mr. and Mrs. Pickens obtained a loan to make repairs to their home. After obtaining the loan, they asked for an additional amount and it was granted. Mr. Pickens passed away in 2012 and shortly thereafter, Mrs. Pickens defaulted on the loan. Discussion followed. Nada Rogers with the Cash Management Department for the City of Beaumont addressed the Commission. Mrs. Rogers suggested that the Commission either foreclose on the loan or continue letting Mrs. Pickens make inconsistent payments towards the loan. A mechanic’s lien was placed on the property. The loan payoff is $26,898.58. This loan was the third loan that the Pickens’ was granted with the City. The first two loans that were granted were paid in full. Mr. Cooper stated in order for the Commission to take action against Mrs. Pickens to foreclose on the home, it would need to be added to the agenda for the next meeting in August and she would need to be notified via certified mail. The Commission agreed to send Mrs. Pickens a certified letter with the intentions to foreclose on her home. THERE BEING NO OTHER BUSINESS, THE MEETING WAS ADJOURNED AT 4:35 P.M. 4
