HomeMy WebLinkAbout3-6-08 BA Minutesl *MINUTES* BOARD OF ADJUSTMENT March 6, 2008 City Council Chambers A meeting of the Board of Adjustment was held on March 6, 2008 and called to order at 3:00 p.m. with the following members present: Chairperson Pat Avery Vice Chairman Dana Timaeus Board Member Joey Hilliard Alternate Member Kelli Maness Board Members absent: Board Member Bob Harris Board Member Mary Jowers Also present: Steve Richardson, Planning Manager; Adina Ward, Planner; Jill Cole, Recording Secretary; Joe Sanders, First Assistant City Attorney APPROVAL OF MINUTES Board Member Hilliard made a motion to approve the minutes of the February 7, 2008 Meeting. Board Member Maness seconded the motion. Motion to approve carried 4:0. SWEARING IN OF WITNESSES PUBLIC HEARING Mr. Richardson stated that Files 565-BA and 566-BA had been postponed. 1) File 567-BA: Request for variances to the minimum side yard building setbacks from 5' to 0.42' and 3.19'. Location: 4960 Washington Boulevard Applicant: Circor Energy Products, Inc. Mr. Richardson presented the staff report. Jennifer Turner, representing Circor Energy Products, Inc., states that Circor is in the process of selling the property to a buyer who is requiring that the variances be granted as a condition before closing on the property. This property and the property to the west were once owned by the same person. The previous owner constructed the buildings a number of years ago and later partitioned the property. The northern building is .42 feet from Z BOARD OF ADJUSTMENT March 6, 2008 the west property line at its narrowest point and the south building is 3.19 feet from the east property line at its narrowest point. The applicant shall have the burden of proof to demonstrate that all three conditions necessary for approval have been met. Thirteen notices were mailed to property owners within 200 feet of the subject property. Two responses in favor and none in opposition were returned. Slides of the subject property were shown. Chairman Avery opened the public hearing and asked for the applicant's comments. Jennifer Turner, representing Circor Energy Products, Inc., addressed the Board and answered questions. Chairman Avery asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Discussion between the Board members followed. CBoard Member Timaeus made a motion to approve a request for variances to the minimum side yard building setbacks from 5' to 0.42' and 3.19' at 4960 Washington Boulevard as requested in File 567-BA. Board Member Hilliard seconded the motion. The motion to approve carried 4:0. OTHER BUSINESS THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED AT 3:24 P. M. 7
