HomeMy WebLinkAbout5-6-10 BA Minutes*MINUTES* BOARD OF ADJUSTMENT May 6, 2010 City Hall, 801 Main Street A Meeting of the Board of Adjustment was held on May 6, 2010 and called to order at 3:00 p.m. with the following members present: Vice -Chairman Pat Avery Board Member Bob Harris Board Member Mary Jowers Alternate Member Christy Amuny Board Members absent: Chairman Dana Timaeus Board Member Joey Hilliard Alternate Member Kelli Maness Alternate Member Christopher Plaunty Also present: Steve Richardson, Planning Manager; Jill Cole, Recording Secretary; Tyrone Cooper, City Attorney APPROVAL OF MINUTES Board Member Harris made a motion to approve the minutes of the Special Meeting held January 21, 2010. Board Member Jowers seconded the motion. Motion to approve carried 4:0. SWEARING IN OF WITNESSES PUBLIC HEARING 1) File 608-BA: Request for a variance to the minimum side yard building setback from 20' to 5'. Location: 5550 Eastex Freeway Applicant: 5550 Eastex Freeway, L.P. Mr. Richardson presented the staff report. 5550 Eastex Freeway L.P., the applicant, owns the office complex. It leases office space on the west end of the building to the State of Texas. The State would like to relocate another of its agencies to a proposed 4,160 sq. ft. expansion of the building. This expansion would put the end of the building 5 feet from the west property line. (( The applicant shall have the burden of proof to demonstrate that all conditions necessary for t, approval have been met. BOARD OF ADJUSTMENT May 6, 20t0 Twenty-seven notices were mailed to property owners within 200 feet. Five responses in favor or in opposition were returned. Slides of the subject property were shown. Mr. Richardson distributed photos of the subject property. Vice -Chairman Avery opened the public hearing and asked for the applicant's comments. John Pat Parsons with Lindsay Law Firm addressed the Board on behalf of 5550 Eastex Freeway, L.P. Vice -Chairman Avery asked for comments in favor or in opposition. Linda McMahen, Coordinator for the Jefferson County Historical Commission, addressed the Board in opposition. Harry Bankston addressed the Board and distributed some photos. Merle Smiley addressed the Board in opposition to the request. Louis Beard, of Counsel for Wells, Peyton and Greenberg Law Firm addressed the Board. Jo Ann Thomas, 2940 Avenue D, addressed the Board. Vice -Chairman Avery closed the public hearing. Discussion followed between Board members. Board Member Harris made a motion to approve a variance to the minimum side yard building setback from 20'to 5' at 5550 Eastex Freeway as requested in File 608-BA. Board Member Amuny seconded the motion. Motion to approve carried 4:0. OTHER BUSINESS THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED AT 4:18 P.M. 2
