BOARD OF ADJUSTMENT
Special Meeting
November 14, 2011
City Hall, 801 Main Street
A Special Meeting of the Board of Adjustment was held on November 14, 2011 and called to order at 3:00
p.m. with the following members present:
Vice -Chairman Pat Avery
Board Member Bob Harris
Board Member Joey Hilliard
Alternate Member Kelli Maness
Alternate Member Christopher Plaunty
Board Members absent: Chairman Dana Timaeus
Board Member Mary Jowers
Alternate Member Christy Amuny
Also present: Adina Ward, Planner; Jill Cole, Recording Secretary; Quentin Price, First
Assistant City Attorney

PUBLIC HEARING
1) File 636-BA: Request for a rehearing to reconsider the vote on File 636-BA, a variance to the
minimum setback for a detached owner identification sign from 10' to 1'.
Location: 1050 IH-10 South
Applicant: Beaumont Chevron
Ms. Ward addressed the Board. At the November 3rd, 2011 meeting, the vote on File 636-BA was
3:2:1 to approve a variance to the minimum setback for a detached owner identification sign from
10' to 1' at 1050 IH-10 South. Board Member Maness abstained because she thought she had a
conflict of interest.
After the meeting, Ms. Maness discussed the alleged conflict of interest with Tyrone Cooper, City
Attorney and it was determined that Ms. Maness did not have a conflict of interest and if she had
voted, the outcome of File 636-BA would have been different.
As per the Bylaws of the Board of Adjustment, no rehearing of any decision by the Board of
Adjustment shall be had except on motion by a member of the Board to reconsider the vote, made
and acted within ten days after its decision and carried by no less than four concurring votes. No

motion for a rehearing shall be entertained except upon written request for rehearing. Ms. Maness
has made a written request for a rehearing. If a rehearing is granted, File 636-BA will be placed on
the December 1, 2011 Board of Adjustment agenda.
Vice -Chairman Avery asked for a motion from the Board.
Board Member Maness made a motion to put File 636-BA on the December 1, 2011 agenda. Board
Member Plaunty seconded the motion. Motion carried 4:1 (Harris).
