HomeMy WebLinkAbout8-4-16 BA Minutes * M I N U T E S * BOARD OF ADJUSTMENT August 4, 2016 City Hall, 801 Main Street A Meeting of the Board of Adjustment was held on August 4, 2016 and called to order at 3:05 p.m. with the following members present: Chairman Dana Timaeus Board Member Jeff Beaver Board Member Mary Jowers Alt. Board Member Lee Smith Board Members absent: Board Member Joey Hilliard Board Member Kelli Manness Alt. Board Member Christy Amuny Alt. Board Member Tom Rowe Also present: Adina Ward, Planning and Zoning; Raymond Rowzee, Planner I, Fran Malvo, Recording Secretary, Sharae Reed, Assistant City Attorney APPROVAL OF MINUTES Board Member Beaver made a motion to approve the minutes from the July 14, 2016, Special Meeting. Board Member Smith seconded the motion. Motion to approve carried 4:0. SWEARING IN OF WITNESSES PUBLIC HEARING 1) File 706-BA: To consider a request for a Special Exception to the minimum rear yard setback from 25’ to 15’. Location: 18 Stone Brook Court Applicant: Sam Bevilacqua, Bevilacqua Construction Adina Ward presented the staff report. Sam Bevilacqua of Bevilacqua Construction is requesting a Special Exception to the minimum rear yard setback from 25’ to 15’. Mr. Bevilacqua is building a new home at 18 Stone Brook Court. The majority of the neighboring structures do not meet city requirements. Section 28.02.005(e)(2)(B)(i) states the board may grant,”…..a year exception where the actual rear yard setback of any four (4) or more lots in the same block do not meet the rear yard requirements…” Board of Adjustment August 4, 2016 Slides of the subject property were shown. Twenty-eight (28) notices were mailed to property owners within 200 feet of the subject property. One response was received in favor and one was received in opposition. Discussion followed between Ms. Ward and Board Member Jowers. Board Member Beaver requested Ms. Ward to review the slides of the subject property. Sam Bevilacqua at 3195 Dowlen Road Suite 101-192 addressed the Board. Mr. Bevilacqua stated he was the owner and the builder of the property. Discussion followed. Di Board member Smith made a motion to approve a request for a Special Exception to the minimum rear yard setback from 25’ to 15’ as requested in File 706-BA. Board member Jowers seconded the motion. Motion to approve carried 4:0. OTHER BUSINESS None. THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED AT 3:20 p.m. 2
