Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on June 2, 2020, at the City Hall Council,Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call * Presentation and Recognition Public Comment: Persons may speak on scheduled agenda items 1-3/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor Dwight Benoit with Magnolia Missionary Baptist Church gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tem Pate, Councilmembers Neild, Getz, Feldschau, Mouton and Samuel. Proclamations, Presentation, Recognitions None Public Comment: Persons may speak on scheduled agenda items 1-3/Consent Agenda None CONSENT AGENDA Approval of minutes — May 26, 2020 * Confirmation of committee appointments — None A) Approve a resolution to repeal Resolution No 20-097 and adopting a new resolution specific to the requirements of the U.S. Department of Justice authorizing the City Manager to receive funds from the Coronavirus Emergency Supplemental Funding Program through the Department of Justice — Resolution 20-109 Minutes — June 2, 2020 B) Authorize the City Manager to execute Change Order No. 1 to the contract with Allco, LLC for the Wastewater Treatment Plant Trickling Filters Rehabilitation Project— Resolution 20-110 C) Authorize the City Manager to execute Change Order No. 10 to the contract with Allco, LLC for the Washington Boulevard Pavement Widening Phase II Project (Corporate Drive to Amarillo Street) — Resolution 20-111 D) Approve a resolution accepting maintenance of the Muela Creek Drive cul-de-sac in Old Dowlen Business Park Section 2, Subdivision — Resolution 20-112 Councilmember Neild moved to approve the Consent Agenda. Consider a resolution authorizing the City Manager to award a contract to King Solutions, Inc., of Houston, to rehabilitate sewer lines and replace manholes. The Pipe Bursting Work Order Contract — Phase III will be used to rehabilitate sewer lines by the pipe bursting method and to replace defective manholes. On February 20, 2020, eight (8) bids were received for furnishing all labor, materials, equipment, and supplies for the project. The Water Utilities Engineer recommends awarding the project to King Solutions Services, LLC, the second low bidder, in the amount of $1,833,508.00. A total of 400 calendar days are allocated for the completion of the project. Minutes — June 2, 2020 Funds will come from the Capital Program. Approval of the resolution. Councilmember Nield moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY APPROVES THE AWARD OF A CONTRACT TO KING SOLUTIONS SERVICES, LLC, OF HOUSTON, TEXAS, IN THE AMOUNT OF $1,833,508.00, FOR THE PIPE BURSTING WORK ORDER CONTRACT -PHASE III PROJECT AND THAT THE CITY MANAGER BY AND HE IS HEREBY AUTHORIZED TO EXECUTE A CONTRACT WITH KING SOLUTIONS SERVICES, OF HOUSTON, TEXAS. Consider a resolution authorizing the City Manager to award a contract to Brystar Contracting, Inc., for the Cartwright Avenue & Goliad Street Storm Sewer Drainage Repair Project. The Cartwright Avenue & Goliad Street Storm Sewer Drainage Repair Project consists of the repair of drainage structures including concrete box culverts, junction boxes, surface inlets and all excavation and backfill as required. On May 14, 2020, six (6) bids were received for furnishing all labor, materials, and equipment for the project. Minutes — June 2, 2020 Councilmember Mouton moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY APPROVES THE AWARD OFA CONTRACT TO BRYSTAR CONTRACTING, INC., OF BEAUMONT, TEXAS, IN THE AMOUNT OF $93,450.00, FOR THE CARTWRIGHT AVENUE AND GOLIAD STREET STORM DRAINAGE REPAIR PROJECT AND THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A CONTRACT WITH BRYSTAR CONTRACTING, INC., OF BEAUMONT, TEXAS. Consider amending Section 18.01.003 of the Code of Ordinances related to Bingo taxes. In 2019, the Texas 86th Legislature enacted House Bill 914 affecting the collection of Bingo prize fees by local jurisdictions. On September 10, 2019, City Council passed Resolution 19- 195 affirming its intent to continue to receive a share of Bingo prize fees collected by non- profit organizations conducting Bingo activities within the City limits. House'Bill 914 allows a licensed authorized organization to collect from a person who wins a cash bingo prize of more than $5.00 a fee in the amount of 5%. The bingo conductor shall remit 50% (or 2.5%) of the amount collected to the State Lottery Commission. The remaining 50% (or 2.5%) shall be remitted to local governing bodies that voted to impose the prize fee. The two local governing bodies are the City of Beaumont and Jefferson County. The City of Beaumont opted to impose the prize fee via Resolution 19-195. As per the State Lottery Commission, Jefferson County did not vote to impose collection of bingo prize fees. Therefore, Section 18.01.003 of the Code of Ordinances adopted in 2007 is no longer in compliance with statutory regulation. The current ordinance levied .a 2% tax on the gross receipts of bingo games conducted within the city. The ordinance should be amended to reflect the current law imposed by House Bill 914 and in accordance the City of Beaumont shall impose a fee of 2.5% of a cash bingo prize of more than $5.00, and said fee is due and payable by the license holder/bingo conductor, quarterly on or before the 25th day of the month succeeding each calendar quarter. Approval of the ordinance. Councilmember Getz moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 18, ARTICLE 18.01, SECTION 18.0.003 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS TO MAKE CHANGES RELATING TO BINGO FEES; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. Councilmember Feldschau seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM PATE, COUNCILMEMBERS NEILD, GETZ, FELDSCHAU, SAMUEL AND MOUTON NAYS: NONE Minutes — June 2, 2020 MOTION PASSED Ordinance 20-022 PUBLIC HEARING Receive comments on the Public Services and Public Facilities and Improvements line items of the Consolidated Grant Program's 2020 Annual Action Plan Public Hearing Open: 1:55 p.m. None Public Hearing Close: 1:55 p.m. 4. Consider approving a resolution adopting the 2020 Annual Action Plan The 2020 Annual Action Plan was adopted by City Council on April 28, 2020. However, HUD is requesting that Council re -adopt the 2020 Action Plan in order to allow additional time for public comment during the disruptions caused by the COVID-19 pandemic. There are no changes to the 2020 Action Plan. As mandated by the U. S. Department of Housing and Urban Development (HUD), City Council has conducted public hearings and work sessions in previous years prior to adopting the City's Annual Action Plan. Planning & Community Development staff, along with the Community Development Advisory Committee (CDAC), has hosted Public Hearings in order to receive public comments on the process and activities related to the 2020 Annual Action Plan. Attached is the proposed Budget for the 2020 Program Year. The proposed budget reflects estimated allocations of $1,361,649 in Community Development Block Grant (CDBG) funding, an estimated $100,000 in Program Income and $477,022 in HOME funding. U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant and HOME Investment Partnership Grant funds. Conduct the Public Hearing and approve the Resolution. Councilmember Samuel moved to APPROVE A RESOLUTION WHEREAS HUD IS REQUESTING THAT THE CITY RE -ADOPT THE 2020 ACTION PLAN AS WELL AS THE BUDGET OF THE 2020 ACTION PLAN, IN ORDER TO ALLOW ADDITIONAL TIME FOR PUBLIC COMMENT DURING THE DISRUPTIONS CAUSE BY THE COVID-19 PANDEMIC, THERE ARE NO CHANGES TO THE 2020 ACTION PLAN OR THE BUDGET OF THE 2020 ACTION PLAN. THE CITY COUNCIL HERE RE -ADOPTS THE HUD CONSOLIDATED GRANT PROGRAM'S 2020 ANNUAL ACTION PLAN, AS WELL AS THE BUDGET OF THE 2020 ACTION PLAN IN THE AMOUNT OF $1,361,649 IN COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG FUNDING, AN ESTIMATED $100,000 IN PROGRAM INCOME AND $477,022 IN HOME FUNDING. MARTIN LUTHER KING, PRAY FOR BEAUMONT AND PRAY FOR AMERICA COUNCILMEMBER GETZ - STATED THAT WHAT HAPPENED TO GEORGE FLOYD WAS INEXPLICABLE, UNCONSCIONABLE AND A TRAGEDY, IT HAS CAUSED AMERICANS ALL ACROSS THIS COUNTRY TO REEXAMINE QUESTIONS THAT NEED TO BE ASKED, THESE QUESTIONS NEED TO BE ASKED IN SUCH A MANNER THAT DOESN'T INVOLVE ARSON, LOOTING, RIOTING BUT PEACEFUL PROTESTING, COMPLIMENTED MICHAEL COOPER AND THE NAACP ON THE PEACEFUL RALLIES THAT HE'S ALREADY LEAD AND CONDUCTED ON LAST WEEK AND THE ONES THAT HE PLANS TO CONTINUE TO CONDUCT, THESE QUESTIONS NEED TO BE ASKED AND REEXAMINED AS WE GO FORWARD IN THE FUTURE, STATED TO MS. ALLEN WHO SPOKE EARLIER THAT IF SHE WOULD LIKE TO GO WITH HIM TO THE MUNICIPAL AIRPORT AND TOUR THE FACILITY TO GET WITH HIM AND HE WILL ARRANGE THAT FOR HER, HE CAN THEN ANSWER ANY QUESTIONS SHE MAY HAVE, THINKS THAT SHE WILL BE AMAZED AND IMPRESSED AS TO WHAT IS GOING ON OUT THERE, ASKED THE CITY MANAGER IF CITIZENS WILL HAVE THE OPPORTUNITY TO OBTAIN SAND BAGS FROM THE CITY OR THE COUNTY IN REGARDS TO THE STORM THAT IS BREWING IN THE GULF, JUST IN CASE IT COMES OUR WAY COUNCILMEMBER NEILD - STATED TO THE CITY MANAGER THAT HE SAW AN EMAIL REGARDING DISPOSABLE WASTE, WOULD LIKE TO CHALLENGE CITY STAFF AS WELL AS THE MANAGER TO BRING TO COUNCIL SOME OPTIONS THAT COULD BETTER HELP THE COMMUNITY HAVE SOME LOCATIONS TO DISPOSE OF THE WASTE AS THE YEAR GOES ON, KNOWS THAT THE CITY PARTNERED WITH THE SOUTH EAST TEXAS REGIONAL PLANNING COMMISSION BUT THINKS THAT HAS BEEN DELAYED FOR THE YEAR OR POSTPONED, DOESN'T THINK THAT ONCE A YEAR IS ENOUGH FOR A CITY THE SIZE OF BEAUMONT, WOULD LIKE TO SEE SOMETHING DONE MORE FREQUENT AND ON A MORE PERMANENT BASIS, TO COUNCILMEMBERS SAMUEL AND MOUTON, STATED THAT HIS. PRAYERS ARE WITH THE AFRICAN Minutes — June 2, 2020 AMERICAN COMMUNITY FOR THE CHALLENGES THAT THEY HAVE HAD IN THE PAST AND IN THE FUTURE, HE CAN'T SPEAK FOR ANYONE ELSE ON THE DIAS OR ANY OTHER CITIZEN BUT HE CAN SPEAK FOR HIMSELF AND HIS FAMILY, WHAT TOOK PLACE LAST WEEK ISN'T FAIR, WASN'T RIGHT AND SHOULDN'T HAVE HAPPENED PERIOD CITY ATTORNEY COOPER - NONE CITY MANAGER HAYES - NONE MAYOR AMES - STATED THAT SHE HAS THOUGHT A LOT ABOUT WHAT HAS HAPPENED AND CAN'T BEGIN TO SAY THAT SHE IMPARTIALLY UNDERSTANDS WHEN SHE SEES HER FRIENDS UPSET AND THE CONVERSATIONS THEY HAVE TO HAVE WITH THEIR CHILDREN, STATED THAT SHE LOVES HER BLACK AND HISPANIC FRIENDS AS MUCH AS SHE LOVES HER WHITE FRIENDS, HAS A HARD TIME UNDERSTANDING THE RACISM BECAUSE SHE DOESN'T FEEL IT, SHE KNOWS HOW SHE FEELS AND KNOWS HOW HER FRIENDS, THAT SHE'S TALKED TO FEEL, CAN ONLY SAY THAT SHE CAN'T COMPREHEND WHAT IT MUST BE LIKE, IT MAKES HER FEEL VERY SAD, SOME SAY AS A LEADER YOU HAVE TO GET IN FRONT OF THINGS, THAT'S TRUE BUT ALSO AS A LEADER YOU HAVE TO UNDERSTAND THAT SOMETIMES OTHERS UNDERSTAND AND KNOW BETTER WHAT TO DO AND WHAT TO SAY, THOUGHT ABOUT HAVING A PRESS CONFERENCE, THOUGHT ABOUT PUTTING INFORMATION OUT ABOUT WHAT SHE'S THINKING BUT DOES THINK THAT HER COHORTS ON COUNCIL AS WELL AS MICHAEL COOPER AND VERNON DURDEN WITH NAACP AND 100 BLACK MEN UNDERSTANDS IT BETTER THAN SHE DOES, HAS ASKED THEM TO HELP OUR CITY HEAL BUT ALSO ASKED THEM TO BRING OUR CITY TOGETHER AND TO MAKE SURE THAT WE DON'T HURT EACH OTHER, WE NEED TO SUPPORT FREEDOM OF SPEECH, VERY PROUD AND THANK THOSE THAT HAVE LEAD THESE EVENTS/PROTEST AND HAVE KEPT THEM PEACEFUL, JUST CAN'T COMPREHEND THESE TYPES OF THINGS STILL HAPPENING IN THIS DAY AND TIME, PRAYS EVERYDAY THAT THINGS GET BETTER, IT'S HER WISH THAT IN THE DAYS TO COME EVERYONE CAN LOVE EACH OTHER AS FRIENDS, BROTHER AND SISTERS therf. being Be ly Am ¢s,' Mayor Executive Session, Council adjourned at 2:47 p.m. Tina Broussard, City Clerk Minutes — June 2, 2020
