The term would commence February 4, 2020 and expire September 30, 2021. (Mayor Becky Ames) Minutes — February 4, 2020 Elise Fulton Smith would be appointed to the Community Development Advisory Committee. The term would commence February 4, 2020 and expire September 30, 2021. (Mayor Becky Ames) A) Approve the renewal of an annual software maintenance agreement with Cityworks — Resolution 20-020 B) Authorize the City Manager to enter into a contract with Legacy Community Development Corporation related to the use of HOME Investment Partnerships funds from the Department of Housing and Urban Development — Resolution 20-021 Councilmember Samuel moved to approve the Consent Agenda. Cardinal Drive. Cardinal RV Parks, L.L.C., is requesting a Specific Use Permit to allow an RV (Recreational Vehicle) park at 2575 W. Cardinal Drive. The proposed RV Resort will consist of 50 pad sites with 50 AMP electrical and 4" sewer connections. The rental office will be staffed and open for business 24 hours per day. The site plan does not show perimeter landscaping along Bragg Circle. Trees and shrubs must be installed according to Ordinance requirements. At a Joint Public Hearing held on January 27, 2020, the Planning Commission recommended 8:0 to approve the request for a Specific Use to allow a Recreational Vehicle Park in an LI (Light Industrial) District at 2575 W. Cardinal Drive with the following conditions: 1. Park shall be surrounded by an eight (8) foot tall solid, permanent screening fence including the south side. 2. Landscaping buffer for parking adjacent to city right-of-way shall be provided at both Cardinal Drive and Bragg Circle. 3. Driveway to be approved by TXDOT. Approval of the ordinance with the following conditions: 1. Park shall be surrounded by an eight (8) foot tall solid, permanent screening fence including the south side. 2. Landscaping buffer for parking adjacent to city right-of-way shall be provided at both Cardinal Drive and Bragg Circle. 3. Driveway to be approved by TXDOT. Councilmember Neild moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW A RECREATIONAL VEHICLE (RV) PARK IN A LI (LIGHT INDUSTRIAL) Minutes — February 4, 2020 DISTRICT AT 2575 w. CARDINAL DRIVE, WITH THE CONDITIONS, IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. Councilmember Mouton seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM PATE, COUNCILMEMBERS NEILD, GETZ, FELDSCHAU, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Ordinance 20-002 2. Consider a request for an Amended Specific Use Permit to allow the expansion of a bar in a GC -MD (General Commercial -Multiple Family Dwelling) District located at 6210 Phelan Boulevard. L.W. Beaumont, LLC received a Specific Use Permit to allow a sports bar at 6210 Phelan Boulevard in October 2018. The plans called for the use of the interior space as well as a covered area. An application for a building permit was submitted for the restaurant/barwhich included a 4,024 square foot interior area and a 2,912 square foot covered patio area, with no exterior seating shown. The registered design professional, H.M. McLeod, estimated the occupancy at 395 which was within the 428 max occupant allowance according to the 2015 International Building Code. ,Following interior demolition of the space, permit #18-3843 was approved for the restaurant/bar. During a final inspection, unapproved changes/alterations were found that were not shown on the original, permitted plan set. The major change from the original approved plan submission was the expansion and improvements to the grassy area outside of the covered patio area. A fence was extended to allow for additional customer seating and customer activities. This additional customer area required additional means of egress within the fenced in area. This required multiple conversations with the design professional as the owner was concerned about controlled access to his business versus the required emergency egress to' meet code. Multiple plan revisions were submitted for consideration. Three occupant loads were specified by the applicant's design professional for the temporary occupancy of the building. The interior building was calculated at 200 people, the outside covered patio was calculated at 209 people, and the uncovered grass area was calculated at 381 people. Also, during the plan revision process further discussions revealed that Little Woodrow's was operating as more of a bar which served food, rather than a bar/restaurant. This reclassification of use would require Little Woodrow's to add additional plumbing fixtures to the facility. An application for a new building permit was submitted by Classic Construction to add ten additional bathroom fixtures and four additional lavatories to meet a new proposed occupancy count of 700. The permit was placed on hold for consideration by the Planning Commission and City Council. Little Woodrow's is located at the southeast most tip of the Colonnade Shopping Center. As a requirement for the original Specific Use Permit, screening and a masonry wall were installed. The new addition will be approximately 1,500 square feet and include new cooler/storage space and additional restrooms to accommodate the additional occupancy and seating area. This addition will be located along the east side of the building providing Minutes — February 4, 2020 an additional buffer from noise for the adjacent residential neighborhood. With regard to parking, it should be noted that concerns have been raised by other tenants about the availability of adequate parking. It should also be noted that the calculation of occupancies is set forth in the Building, Fire and Plumbing Codes, whereas the calculation of required off-street parking is set forth in the Zoning Ordinance, reviewed by the Engineering Department. A parking analysis was conducted as part of this revised Specific Use Permit. It found that while demand for the parking spaces at the interior of the shopping center is high, the minimum of spaces has been provided at the shopping center, albeit some spaces are located farther afield at the perimeter of .the shopping center. At a Joint Public Hearing held on October 21, 2019, the Planning Commission recommended 5:0 to approve the request for a Specific Use Permit to allow the expansion of a bar in a GC - MD (General Commercial -Multiple Family Dwelling) District with the following conditions: 1. Install an eight foot (8') tall opaque perimeter fence. 2. Keep litter in direct area of subject property contained. 3. No live music allowed. The Zoning Ordinance states, "The City Council shall not amend, supplement, change, modify or repeal any regulation, restriction or boundary or approve a Specific Use Permit where a protest against such change (has been filed), signed by the owners of twenty percent (209,6) or more either of the area of the lots included in such proposed change or of the lots or land immediately adjoining the same and extending two hundred (200) feet therefrom, except by the favorable vote of three-fourths (3/4) of all the members of the City Council." Protest against this request was received from more than 25% of the land immediately adjoining the subject property. Therefore, a vote of three-fourths (3/4) of the City Council shall be required to approve the requested Specific Use Permit. In an effort to mitigate the impact of the business on surrounding land uses, the applicant has offered to limit the number of occupants to four hundred (400) and, working with the owner of the center, provide additional parking spaces, dedicated for the adjacent tenant. At the December 10, 2019 City Council Meeting, it was noted that the site plan did not accurately reflect the parking layout. Council voted to request a revised site/parking plan and send the item back to the Planning Commission for review. Engineering has reviewed the revised parking plan and found that the minimum number of required parking for the shopping center is four hundred five (405) and with some minor modifications to the proposed parking layout it appears that this minimum parking requirement can be provided. The Engineering Division will need to review and approve the final parking layout. Councilmember Getz moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE ISSUING AN AMENDED SPECIFIC USE PERMIT TO ALLOW THE EXPANSION OF A BAR IN A GC -MD (GENERAL COMMERCIAL -MULTIPLE FAMILY DWELLING) DISTRICT FOR PROPERTY LOCATED AT 6210 PHELAN BOULEVARD, WITH THE (4) FOUR CONDITIONS RECOMMENDED BY THE ADMINISTRATION, IN CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. Councilmember Neild seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM PATE, COUNCILMEMBERS NEILD, GETZ, FELDSCHAU, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Ordinance 20-003 3. Consider a resolution authorizing the City Manager to submit a grant application to the Texas Department of Transportation (TxDOT) for the purchase of new buses for the transit system. In order to continue to offer a high-quality public transit service within the city, the transit system's vehicle fleet should be replaced and upgraded over time. Last year, two (2) small, CNG -fueled buses were added to the on -demand paratransit service fleet and the year before that, three (3) new large, CNG -fueled buses were added to the fixed -route fleet. The proposed grant would include a request to purchase four (4) small paratransit buses and three (3) large, fixed -route buses. The estimated cost for the small buses is $120,000 each and they are expected to be in service for a minimum of five (5) years and 150,000 miles. The large buses are estimated to cost $525,000 each and are expected to be in service for a minimum of twelve (12) years and 500,000 miles. As these are minimums, we expect much longer service life for both types of vehicles; however, as with any vehicle, as they age, the ongoing maintenance costs continue to increase. It should be noted that historically, the required local match for vehicle grants has been 20%; however, the current rules require a 50% match. As such, the proposed budget for the grant request will be $2,055,000, with a local share of $1,027,500. It should be noted that TXDOT has given no clear indication of how much funding the system might be awarded and as such, the grant amount and related local match could be significantly less. TXDOT will announce grant awards and amounts in May, 2020. All vehicles that will be replaced as a result of this grant award will have met their Minutes — February 4, 2020 FTA minimum age and mileage requirements. In prior discussions regarding the types of buses that should be purchased, the question of "low ridership" or few riders on big buses is often raised. To that end, there is currently consideration for a pilot project to use smaller buses on fixed routes with low ridership. However, a variety of factors should be considered. First, while larger buses are more than three times more expensive than small buses, their expected life is much more than'three times the useable life (years and mileage) of the small buses. In addition, the operating costs (drivers, fuel and maintenance) of small buses is similar to the large buses. Second, larger buses can carry three times as many people. While this may not be an issue on low - ridership routes, especially at peak times, there may be occasions where more than ten (10) riders wish to use the bus, which would result in a denial of service to the rider. In addition, during an evacuation, larger buses will allow for faster evacuation of more citizens. Finally, having fewer large buses, will affect the ability to exchange buses on busier routes where a bus may be out of service due to an accident and/or a mechanical issue. The grant will pay up to 50% of the costs of the new buses, with a required 50% match to be funded by the Beaumont Municipal Transit Fund. Approval of the resolution. Councilmember Mouton moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO APPLY FOR GRANT FUNDING IN AN AMOUNT OF $2,055,000.00 THROUGH THE TEXAS DEPARTMENT OF TRANSPORTATION (TXDOT) FOR THE PURCHASE OF FOUR (4) SMALL PARATRANSIT BUSES AND THREE (3) LARGE FIXED -ROUTE BUSES FOR THE CITY'S TRANSIT SERVICES AND THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE ALL DOCUMENTS NECESSARY TO APPLY FOR GRANT FUNDING IN AN AMOUNT UP TO $2,055,000.00 THROUGH THE TEXAS DEPARTMENT OF TRANSPORTATION (TXDOT) FOR THE PURCHASE OF FOUR (4) SMALL PARATRANSIT BUSES AND THREE (3) LARGE FIXED -ROUTE BUSES FOR THE CITY'S TRANSIT SERVICES. Consider a resolution approving a contract with SETEX Construction Corporation of Beaumont for the asbestos abatement and demolition of three structures located at 747 College Street. The former Fire Station No 1 located at 747 College Street has been replaced with the new facility located at 1675 Caldwell. The three structures have been experiencing foundation failures, roof leaks, and needs major renovations including asbestos abatement. It is no longer feasible to invest money into this aging facility. Due to the structural issues with the facilities, the demolition of the three buildings is recommended by City staff. The land will be considered for sale once the project has been completed. Minutes — February 4, 2020 Bids were requested for the asbestos abatement of the main building and the demolition of all three structures. Twelve (12) vendors were notified and six bids were submitted. SETEX Construction Corporation provided the low qualified bid in the total amount of $62,480 Funds will come from the Capital Reserve Fund. Approval of the resolution. Councilmember Samuel moved to APPROVE A RESOLUTION FOR THE BID SUBMITTED BY SETEX CONSTRUCTION CORPORATION, OF BEAUMONT, TEXAS, FOR THE ASBESTOS ABATEMENT AND DEMOLITION OF THREE (3) STRUCTURES AT FORMER FIRE STATION NO. 1 LOCATED AT 747 COLLEGE STREET, IN THE AMOUNT OF $62,480.00, BE ACCEPTED BY THE CITY OF BEAUMONT; AND THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A CONTRACT WITH SETEX CONSTRUCTION CORPORATION. AYES: MAYOR AMES, MAYOR PRO TEM PATE, COUNCILMEMBERS NEILD, GETZ, FELDSCHAU, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Ordinance 20-004 WORK SESSION Review and discuss proposed Housing Tax Credit Projects Chris Boone, Community Development Director reviewed and discussed the proposed Housing Tax Credit Projects. Mr. Boone discussed the process overview stating that the developer's pre - application is due to the city by December 1, 2019, however, the city was only notified in mid- January, 2020, the final applications are due to the State by March 1, 2020. It was stated that the process is very competitive, and the scoring criteria is set by TDHCA. For the State to consider a project within the city limits, the city must acknowledge that Beaumont has more than twice the state average of units per capita supported by tax credits and approve the project. Expressing "support", or "no objection" and/or financial assistance for a project results in additional points for an application. TDHCA will announce awards in July, 2020. Once the funding occurs, there will be an, approximate time to start construction which would be in 2021. Minutes — February 4, 2020 The options were discussed such as to support all, some or none of the projects. To take no action then no project would move forward. Acknowledging "twice the state average" for some, none or all of the projects would then get the projects considered by TDHCA. To declare "support" or "no objection" to one or more of the developments would get them greater support to their projects. To offer funding support in the form of (HOME funds, fee waivers, etc.) to a project would also get them greater support to the projects. The guidance that is needed is to identify which, if any, projects to bring forward for consideration at a future meeting and at what level of support for each. When discussing the market demand, it was stated that the City of Beaumont has an existing demand for 7,908 units of income and age -qualified (55+) households and 98.1 % apartment occupancy.
