City Attorney APPROVAL OF MINUTES Alternate Board Member Smith made a motion to approve the minutes for July 11, 2019. Alternate Board Member Rowe seconded the motion. Motion to approve the minutes carried 4:0. SWEARING IN OF WITNESSES PUBLIC HEARING 1) File 742-BA: Consider a request for a Variance to the required minimum yard setbacks in the Neighborhood Design Overlay District from 25’ to 9’5” in the rear yard and from 5’ to 0.1’ in the side yard. Applicant: Ryan Broussard th Location: 875 20 Street Mrs. Josey presented the staff report. The applicant, Ryan Broussard, is requesting a Variance to the required minimum yard setbacks in the Neighborhood Design Overlay District from 25’ to 9’5” in the rear yard and from 5’ to 0.1’ in the side yard. The intent of the Neighborhood Design Overlay District is zoning protection to try to avoid the tearing down of existing small cottages and replacing them with larger oversized homes. The applicant is specifically asking to use the existing slab (footprint) of the previous accessory structure, except it will be larger in size. This structure would have been considered lawful, nonconforming if it had been damaged or destroyed by fire or other calamity. However, as it was torn down intentionally and will be rebuilt; the lawful, nonconforming clause no longer applies. The side of this slab will be located on the property line, and therefore, if approved, there should be no roof overhang or BOARD OF ADJUSTMENT August 1, 2019 water shed onto the neighbor’s property. The applicant shall have the burden of proof to demonstrate that all three conditions necessary for approval have been met. Slides of the subject property were shown. Twenty-one (21) notices were mailed to property owners within 200 feet of the subject property. One was received in favor and none received in opposition. The applicant was present. Discussion followed after Mrs. Josey presented the staff report. The easement is located at the rear of the property and the building will sit on the th property line. The applicant was present. Ryan Broussard, 875 20 Street, addressed the Board. Mr. Broussard stated that he would like a garage/shop on his property to store his lawn tools. Board Member Rowe asked Mr. Broussard if he already poured the slab. Mr. Broussard replied, “Yes”. Mr. Broussard stated that he also trying to make the home look the way it once did. Discussion followed amongst the board members. Mrs. Josey stated that Mr. Broussard would have to get a windstorm engineer to approve the slab before it can be used. Alternate Board Member Rowe made a motion to deny the request for a Variance to the required minimum yard setbacks in the Neighborhood Design Overlay District from 25’ to 9’5” in the rear yard and from 5’ to 0.1’ in the side yard as requested for File 742-BA. Alternate Board Member Smith seconded the motion. Motion to deny carried 4:0. Mr. Broussard asked what his options were. A brief discussion followed between Mr. Broussard and the Board regarding his options. OTHER BUSINESS None. THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED AT 3:39 p.m. 2
