HomeMy WebLinkAbout3-11-19HLCminutes * M I N U T E S * HISTORIC LANDMARK COMMISSION March 11, 2019 City Hall, 801 Main Street, Beaumont, Texas A Regular Meeting of the Historic Landmark Commission was held on March 11, 2019 and called to order at 3:33 p.m. with the following members present: Chairman Paula Blazek Vice-Chairman Dohn LaBiche Commissioner Thomas Sigee Commissioner Marty Craig Commissioner Janelle Templeton Commissioner Jefferson Fisher Commissioner Lynda Kay Makin Commissioner Theresa Goodness Commissioner Dennis Kiel Commission Members absent : Commissioner Marie Broussard Commissioner Carol Fernandez Councilmembers present: Councilmember Virginia Jordan Councilmember William Sam Also present: Adina Josey, Senior Planner Fran Malvo, Recording Secretary Elayna Luckey, Historic Code Enforcement Officer APPROVAL OF MINUTES Commissioner Makin made a motion to approve the minutes of the Regular Meeting held on February 11, 2019. Commissioner Sigee seconded the motion. Motion to approve carried 9:0. REGULAR MEETING 1) CA-3007: Request for a Certificate of Appropriateness to install solar panels on a roof. Applicant: Greg Busceme, Sr. Location: 2495 McFaddin Avenue Mrs. Josey presented the staff report. Greg Busceme, Sr. would like to add solar panels on the south side of his home located at 2495 McFaddin Avenue. Mr. Busceme plans to attach the panels to the roof of his home. The property is a corner lot and the rear yard would be Historic Landmark Commission March 11, 2019 visible from the side street. Solar panels would be installed on every portion of the roof except that part facing the front yard. As discussed in an attached article, the National Trust seems to be in favor of solar panels as long as they are not visible from the street. At the February Historic Landmark Commission meeting, the applicant stated that there were laws that do not allow restriction of solar panel placement. Our research has not revealed any State or Federal law that preempts local government from controlling the use of these panels. Staff recommended approval of the solar panels being placed on the east side of the rear gable, where they will not be visible from an abutting street. The house is not listed in the SPARE survey. Slides of the subject property were shown. Chairman Blazek asked if anything was submitted regarding a profile or color of the solar panels. Mrs. Josey replied he did not. The applicant was present. Greg Busceme, Jr., 2495 McFaddin Avenue, addressed the Commission. Discussion followed regarding the difference between an HOA (Homeowners Association) and the Oaks Historic District. More discussion followed regarding utility easements and utility poles installed next to his property by AT&T. Chairman Blazek stated the solar panels are not to be seen from the street. More discussion followed. No other questions for Mr. Busceme. Chairman Blazek began a discussion on solar panels. Vice- Chairman LaBiche made a motion to approve the installation of solar panels on the southeast side of the home as long as they are not visible from the street on the front and street side of the house. Commissioner Craig seconded the motion. Motion to approve carried 9:0. Another discussion ensued regarding the visibility of the solar panels. Mr. Boone stated that guidelines can be put in place for the applicants that wish to install solar panels on their residence. 2) CA-3019: Request for a Demolition Certificate for a Duplex. Applicant: David Yermian Location: 2141 Rusk Street, Suites A & B Mrs. Josey presented the staff report. David Yermian has requested a Certificate of Appropriateness to allow the demolition of a residential duplex. This property is located at 2141 Rusk Street, suites A & B. The City has orange tagged this structure for property maintenance. The property has a number of maintenance issues that must be addressed in order for this home to be leased again. The changes needing to be made are, but not limited to, electrical wiring, deteriorated roof, broken windows, foundation beams rotted and termite damaged, holes in the ceiling, floors need leveling and are soft in several places and more. The full list of maintenance needed is attached. Staff recommended approval of this request. This property is listed in the SPARE survey. Site 927, Year 1990. 2 Historic Landmark Commission March 11, 2019 Exhibits are attached. Slides of the subject property were shown. The applicant was not present. Mr. Yermian will pay for expenses incurred for the demolition. Chairman LaBiche asked what is the property zoned. Mrs. Josey stated R-S (Residential Single Family Dwelling). Commissioner Craig made a motion to approve the request for a Demolition Certificate for a duplex. Commissioner Sigee seconded the motion. Motion to approve carried 9:0. 3) Historic District Code Enforcement Report Elayna Luckey presented the Historic District Code Enforcement report. Mrs. Luckey stated that charges were filed against David Bradley. One hundred eight-four (184) inspections were performed for the month of February. Discussion followed regarding 2525 Long Street. OTHER BUSINESS Mrs. Josey asked the Commission to submit resumes to her along with their designated positions. THERE BEING NO OTHER BUSINESS, THE MEETING WAS ADJOURNED AT 4:33 P.M. 3
