City Attorney Myrtle Corgey City Clerk -000- The Invocation was given by Mr. Famous W. Byers, Ridgewood Church of Christ . The Pledge of Allegiance was led by Councilwoman McGinnis. -000- A motion to approve the minutes of the regular City Council session held June 28 , 1977 , was made by Councilwoman McGinnis and seconded by Council- man Evans . Mr. J. C. Leggett , 1849 Washington Blvd. , addressed Council to request the first reading of the A.T. S .F. Railroad Franchise renewal ordi- nance for Tracks 72 & 85 be deleted from the Minutes of the Meeting. Question on motion : Ayes : All Nayes : None -000- Resolution 77-194 authorizing the award of bid to Dixie Truck Center for furnishing replacement vehicles (2 vans - $10, 148.00 and 2 pickup trucks - $9, 912 . 00) was approved on a motion made by Councilwoman McGinnis and se- conded by Councilman Evans. Question : Ayes : All Nayes : None -000- Resolution 77-195 authorizing the award of bid to Preceptor Company to print and bind 2, 150 books for the Safety Education Program for $1 , 840.00 (grant to pay printing costs) was approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis. Question : Ayes : All N-ayes : None -000- Resolution 77-196 authorizing the City Manager to execute an amendment to the agreement with Dickson, Dickson & Bullock for architectural services necessary for the addition of a sound system to the Faix Park Arena at a cost of $2, 400. 00 was approved on a motion made by Councilman Cash and se- conded by Councilman Evans . Question : Ayes : All Nayes : None Mr. Paul Hay, architect with Dickson, Dickson & Bullock, gave brief up-date on the project . -000- Resolution 77-197 authorizing payment to Williamson Insurance Agency for various insurance bonds and policies in the amount of $10,267 was approved on a motion made by Councilman Evans and seconded by Councilman Cash. Question : Ayes : All Nayes : None -105- July 12, 1977 Resolution 77-198 authorizing the firm of C. A. Kohler, Consulting Engineers, to prepare plans and specifications for the construction of a sanitary sewer line along Delaware, eastward from Dowlen Road, for approximately 4, 300 feet, was approved on a motion made by Councilman Cash and seconded by Councilman Evans . Question: Ayes : All Nayes: None -000- Resolution 77-199 appointing Sarah Mallec (replacing Sharon McCabe) and Ed Sigee (replacing Jim Swicegood) to three year terms and reappointing Olivia Gonzales, Walter Keneson and Patty Cantella to three year terms and appoint- ing Patty Cantella to Chairman and Marilyn Adams Vice-Chairman of the Com- munity Development Block Grant Advisory Committee was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Cash. Question : Ayes : All Nayes : None -000- Ordinance No. 77-72 amending the ordinance controlling the sale and consump- tion of alcoholic beverages at Fair Park was considered: ORDINANCE NO. 77-72 ENTITLED AN ORDINANCE AMENDING CHAPTER 25 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT, TEXAS, TO PROVIDE FOR THE SALE OF ALCOHOLIC BEVERAGES AT THE HARVEST CLUB, YMBL BUILDING AND THE ARENA AT FAIR PARK; PROVIDING FOR SEVERABILITY, PROVIDING FOR REPEAL AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Williams and se- conded by Councilwoman McGinnis . Question: Ayes : Mayor Ritter Nayes : Councilman Cash Councilwoman McGinnis Councilman Evans Councilman `',Tilliams -000- Resolution 77-200 authorizing payment of $1024. 76 to J. T. Automotive for the purchase of parts to overhaul the engine of Solid Waste garbage truck #60-6045 was approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis. Question : Ayes : All Nayes : None -000- Resolution 77-201 authorizing repairs by Kinsel Ford, Inc . to 1976 Ford Police Interceptor #10-1083 at a cost of $1 ,756. 08, was approved on a mo- tion made by Councilwoman McGinnis and seconded by Councilman Cash. Question : Ayes : All Nayes : None -000- Ordinance No.. 77-73 appropriating $1 , 989. 50 from unallocated CIP Water Funds to Project 80-71-032 Amelia Extension/Fire Hydrants for the installa- tion of two (2) fire hydrants in the Amelia area was considered: ORDINANCE NO. 77-73 ENTITLED AN ORDINANCE AMENDING THE BUDGET OF THE CITY OF BEAUMONT FOR THE FISCAL PERIOD COMMENCING OCTOBER 1 , 1976, AND ENDING SEPTEMBER 30, 1977, BY TRANSFERRING $1 , 989. 50 FROM UNALLOCATED C. I .P. WATER FUNDS TO PROJECT 80-71-032 FOR THE INSTAL- LATION OF TWO (2) FIRE HYDRANTS . The ordinance was approved on a motion made by Councilman Williams and se- conded by Councilwoman McGinnis. Question: Ayes : All Nayes : None -106- July 12 , 1977 Resolution 77-202 authorizing the City Manager to make application to the Economic Development Administration for local Public Forks Round II Funds (Jefferson County is to receive these Planning Target Funds and intends to use $52 , 500. 00 in Beaumont but the City is required to make application for such to E.D.A. -- proposed funds to be spent to overlay Park Street from College to Railroad) was approved on a motion made by Councilman Wil- liams and seconded by Councilwoman McGinnis. Question: Ayes : All Nayes : None -000- The second reading of an ordinance granting the Atchison, Topeka and Santa Fe Railway Company a renewal franchise for Tracks Nos . 72 and 85 was held: AN ORDINANCE AN ORDINANCE GRANTING TO THE ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY, A DELAWARE CORPORATION, ITS SUCCESSORS, ASSIGNS AND LESSEES, THE RIGHT AND PRIVILEGE TO MAINTAIN AND OPERATE ITS INDUSTRY LEAD TRACK NO. 72 IN, ALONG, UPON, OVER AND ACROSS MAGNOLIA, LONG AND GRAND AVENUES, WILLOW, PEARL AND PINE STREETS , AND A PUBLIC ROAD OR STREET LEADING TO THE CITY DUMP, IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AND THE RIGHT AND PRIVILEGE TO MAINTAIN AND OPERATE ITS INDUSTRY LEAD TRACK NO. 85 IN, ALONG, UPON, OVER AND ACROSS GILBERT STREET, HOLMES AVENUE, MILAM STREET, ARCHIE AVENUE, FRANKLIN, BLANCHETTE, NECHES AND MAIN STREETS, IN SAID CITY, ALL IN ACCORD WITH EXHIBIT ATTACHED HERETO; PROVIDING THAT SAID TRACKS SHALL BE USED ONLY FOR THE PURPOSE OF LOADING, UNLOADING AND SWITCHING TO INDUSTRIAL TRACKS SERVING COMMERCIAL AND INDUSTRIAL ENTERPRISES; PROVIDING REGULATIONS AND RESTRICTIONS FOR THE USE OF SAID TRACKS; PROVIDING THAT SUCH MAINTENANCE AND OPERATION BE IN ACCORDANCE WITH THE CHARTER AND ORDINANCES OF THE CITY AND THAT CERTAIN MAINTENANCE WORK SHALL BE DONE AT THE DIRECTION OF THE CITY ENGINEER; PROVIDING FOR THE ACCEPTANCE AND FEE HEREUNDER; PROVIDING THAT THIS FRANCHISE IS SUBJECT TO THE CHARTER AND ORDINANCES OF THE CITY OF BEAUMONT AND PROVIDING FOR TERMINATION FOR FAILURE TO USE THE TRACKS FRANCHISED HEREUNDER; PROVIDING FOR TERMINATION OF THIS FRANCHISE ON JUNE 24, 1982 , AND THE RESTORATION OF SAID STREETS WITHIN NINETY (90) DAYS THEREAFTER; AND PROVIDING FOR INDEMNIFICATION OF THE CITY OF BEAUMONT. The ordinance was passed to its third and final reading on a motion made by Councilman Cash and seconded by Councilwoman McGinnis. Question : Ayes : All Nayes : None -000- Mrs. Delia Harrington, 815 Willow Street , named numerous sites where she had discovered stacks of trash and litter and asked that Council contact property owners to clean them up. Mr. Fairburn Moseley, President of Oil Chemical & Atomic Workers Interna- tional Union Local 4-243 , addressed Council to express his concern for the lack of progress on the Irving Street Underpass. Mr. 0. C. Hebert , retired Mobil Oil employee, addressed Council in support of statements by Mr. Moseley concerning the need for the Irving Street Underpass. Mr . L. P. Kinnear, 2395 Park Street , addressed Council to complain of the high rates charged by Entex and Gulf States Utilities. -000- There being no further business, the meeting was recessed before continuing with the City Council Workshop session . -107- July 12, 1977 I , Myrtle Corgey, City Clerk of the City of Beaumont , Texas , certify that the above is a true copy of the regular City Council session held this 12th day of July , 1977 .
