BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 9th day of November, 1993 , with the following present: HONORABLE: Evelyn M. City Manager Lane Nichols City Attorney Rosemarie Chiappetta City Clerk -000- The Invocation was given by the Reverend G. W. Daniels, Sunlight Baptist Church. The Pledge of Allegiance was led by Councilman Davis. -000- Four Proclamations were issued: "Boys' Haven Day, " November 13, 1993 ; recognizing the Ninetieth Anniversary of the "Chamber of Commerce; " recognizing "Cerebral Palsy Rehabilitation Center" as one of Beaumont's special health care organizations for children with disabilities; and recognizing the Ninetieth Anniversary of "Mobil Oil Corporation. " -000- Symphony of Trees ' representatives, accompanied by Santa and Rudolph the Red-nosed Reindeer, presented Council with Christmas decorations to begin trimming a Christmas tree for the 15th Annual Symphony of Trees extravaganza, to be held at the Civic Center December 3-5, 1993 . The decorated trees will bear the Councilmembers name and placed on sale to the public with proceeds benefiting the Symphony of Southeast Texas. -000- Citizen comment was invited on the Consent Agenda and Main Agenda Items -281- November 9, 1993 2 through 6. No one wished to address these subjects. -000- The following Consent Agenda items were considered: Approval of the Minutes of the regular City Council session held November 2, 1993 ; Resolution No. 93-277 appointing Scarlett Duplechain to the Small Business Revolving Loan Board for a term expiring December 31, 1995, and Becki Stedman to the Historical Landmark Commission for a term expiring October 31, 1995; and Resolution No. 93-278 approving a letter agreement with Trinity Industries, Inc. and Slamback Partners for use of their property for a maximum of twelve months as a detour to the Fire Training Grounds and the Yacht Club during the Brakes Bayou Bridge repairs. The Consent Agenda was approved on a motion made by Councilman Cokinos and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Ordinance No. 93-66 authorizing a zone change for the 2600 block of Long Avenue, east of 11th Street, described as the rear of east 25 ' x 150 ' west half of Lot 12 , Block 55, Averill Addition from RS (Residential Single Family Dwelling District) to GC-MC (General Commercial Multiple- Family Dwelling District, to utilize the property for a driveway to serve a medical clinic at the request of the Beaumont HHC Development Corporation was considered: ORDINANCE NO. 93-66 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING OF PROPERTY PRESENTLY ZONED RS (RESIDENTIAL SINGLE FAMILY DWELLING DISTRICT) TO A GC - MD (GENERAL COMMERCIAL MULTIPLE FAMILY DWELLING DISTRICT) FOR 0. 086 ACRES OF LAND, MORE OR LESS, BEING THE WEST ONE HALF OF LOT 12 , BLOCK 55, AVERILL ADDITION TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Ordinance No. 93-66 was approved on a motion made by Councilman Cokinos and seconded by Councilman Alter. Question: Ayes: All Nayes: None -282- November 9, 1993 Ordinance No. 93-67 amending Section 26-24 of the Code of Ordinances to extend the reduced speed limits for school zones on Dowlen and Gladys an additional 15 minutes until 4 : 15 p.m. was considered: ORDINANCE NO. 93-67 ENTITLED AN ORDINANCE AMENDING CHAPTER 26, SECTION 26-24 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO EXTEND THE TIME LIMITS IN SCHOOL ZONES IN SCHEDULE B AND SCHEDULE C; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Ordinance No. 93-67 was approved on a motion made by Councilman Alter and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Resolution No. 93-279 authorizing acquisition of Parcel 105: 0.8225 acre tract of land out of Lots 1, 2 , 3 , and 4, Block 6, Laurel Heights Addition and a portion of the abandoned Liberty Street right-of-way for the appraised value of $243 , 637 . 00 from John Frederic Simon, Helen Ruth Goldstein, Jennifer L. Goldstein Flanagan, Amy R. Goldstein Stusek, Eric L. Goldstein, Julie D. Simon, John F. Simon, Jr. Richard L. Simon and John F. Simon as Trustee of the Betty Simon Goldstein Trust for the Liberty-Laurel Phase III Project was approved on a motion made by Councilman Alter and seconded by Councilman Davis. Question: Ayes: All Nayes: None -000- Resolution No. 93-280 authorizing acceptance of the bid of A-Way Tank Services, Inc. in the amount of $46, 900. 00 for the cleaning and repainting of the exterior of the 1. 0 million gallon West Elevated Water Storage Tank located on Liberty at 13th Street; and Resolution No. 93-281 authorizing acceptance of the bid of A-Way Tank Services, Inc. in the amount of $43 , 600. 00 for the cleaning and repainting of the exterior of the 1. 0 million gallon South Elevated Water Storage Tank located on Sabine Pass at Harriott Street were approved on a motion made by Councilman Moore and seconded by Councilman Alter. Question: Ayes: All Nayes: None -000- Resolution No. 93-282 authorizing a contract with the Innovative Housing Development Corporation in the amount of $126, 000. 00 to operate a -283- November 9, 1993 program to acquire and rehabilitate rental housing for low to moderate income persons with funds from the 1992 HOME Program Grant was approved on a motion made by Councilman Moore and seconded by Councilman Alter. Question: Ayes: All Nayes: None -000- Resolution No. 93-283 establishing an honorary position of Emeritus Commissioner of the Library Commission with a lifetime non-voting membership to be conferred upon members in recognition of long and particularly meritorious service by the City Council and appointing Mrs. W. C. Tyrrell as the first Emeritus Commissioner of the Library Commission was approved on a motion made by Councilman Cokinos and seconded by Councilman Moore. Question: Ayes: All Nayes: None Council expressed their appreciation to Mrs. Tyrrell for her years of dedicated service to the Library Commission and told her that she is held in high esteem for her community efforts. Also, appreciation was expressed to the library system for serving the youth of the community with the tools to empower and enrich their lives. Mayor Lord extended Mrs. Tyrrell an opportunity to address Council and the public. Mrs. Catherine Tyrrell : You know, this is the time of life that they say is the "golden years. " This is the first gold that I 've seen in a long time! But, it has been an enriching, an enlightening and learning experience to have worked with the Commission, and, as I 've told someone, I really should just get a star for attendance, not for my abilities. But, anyway it has been just exciting to see what has happened in the time, tenure that I 've been with the Library Commission. We've seen the building of the Beaumont Public Library, we've seen the Branch Libraries, and we've seen the renovation of the Tyrrell Library, and that is not only with the help of the Commission, the Council, but the people of Beaumont, and it has really been a joy. And, among the highlights of the years was the fact that I was on a committee that selected Maurine Gray as our Library Director. And what have we seen in these years since Maurine has taken over, but growth in the system, in the libraries here and everything there is. And so, thank you, Mayor, Council, Commission and everybody. This is indeed an honor, and I 'm very grateful . Mayor Lord recognized the Library Commission members in attendance and Library Director Maurine Gray and thanked them for their fine work. -000- Mayor Lord announced that an Executive Session will be conducted in -284- November 9, 1993 accordance with Section 551. 071 of the Texas Open Meetings Act to discuss contemplated and pending litigations: David L. Shows vs. City of Beaumont following the regular session of City Council. -000- Councilman Moore stated that he was absent from Council last week due to employment obligations, but thanked Council for the action taken regarding the agreement with the Beaumont Retirement Hotel and said he thinks a good compromise was reached. Also, Councilman Moore reported that a ground-breaking ceremony for a fitness trail behind McArthur School was held yesterday by the South Park Rotary Club in conjunction with the school, local businesses and the South Park Neighborhood Association. He said this is a great sign of the community working together with their resources. Councilman Alter said he looks forward to Mobil 's birthday celebration and the Spindletop Ball this week and congratulated the Convention and Visitors' Bureau and those involved with the Babe Zaharias function held last night and congratulated Texas Tech all-American basketball star Sheryl Swoopes as winner of the Babe Zaharias Female Amateur Athlete Award. Mayor Lord said that last night was a special evening and that a lot of events have been happening this week. In addition to meeting with Mobil Oil representatives in celebration of the company' s 90th anniversary, she was invited to inspect the ROTC Corps at Westbrook High School this morning, and the 123 young people were very impressive. She thanked Channel 12 for publicizing the occasion and said that many young people in our community are involved in good activities. Also, she said that Texas Commerce Bank conducts a program in the schools to teach youngsters about banking, and that last week she served as a teller at Fletcher Elementary School and enjoyed participating in this learning experience for the students. -000- There being no further business, the Regular Session of City Council was recessed to reconvene in Executive Session to be followed by a Workshop Session in the Executive Conference Room. -000- I, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the Minutes of the Regular City Council Session held November 9, 1993 .
